tion in our District Court of Red River County' al-
ledging that vou and one 'Robert Hamilton are in
debted to hiin irithesum of six huud red dollars
lor services rendered as an overseer upon a plan-
tation in Hickman's Prairie Bowie Countywoik-
dby you'andsaid Hamilton as partners in the year
eighteen hundred and forty-one ad which said
4um was to have been paid him at the close of that
year and has prayed for process and judgment
accordingly to which petition the s id Thomp-
son by iiis Atturney has appended an affidavittha
yo are a non-resident of the Republic of Texas.
You are therefore hereby notified ol the pending
of said suit and ordered to appear before uur Dh-

the said Jacob Black deceased to be and personally
appear at the court house in the town of Bonham
in said county on the first Monnay of March next
(1845) at the District Coun then and thene to be
held and detend the said suit; and that unless they
do. so appear the same will be heard anddeiermm
ed in 'heir absence.
Said petition charges that Jacob Black on (he
Snd ot January 1841 made and delivered his note
under seal to Nancy K Woodrow for the sum of
one thousand dollars to be paid on or before the
2nd of Jannary 1842 with ten percent interest from
date; and to secure the payment ot said sum of
money said Black executed and delivered at the
same time a deed of mortgage on 982 acres ol'land
lying in said county conditioned to be void upon
thepayment on the 2nd of Jauuary 1842 of the
said sum oi money with the ten' per cent interest.
Said peVitiun chargts that said Jacob Blaek-died
inestate in Decomber 1841 oriri the forepart o.r
January 1842; and that the above named defend-
ants are his legal heirs and that the said sum of
money has not been paid or the said mortgage dis-
charged by said Black in his'lifetimeor by!his heirs
or administrator since his death Also that Nancy
K. Woodrow died intestate in August 1842 and.
thai the Tlaintiff Simeon K. Woodrow is her ad-
ministrator and now seeks to foreclose said mort-
