You are hereby commanded to
summon Joab S. Perry, and the
unknown heirs of Joab S. Perry,
deceased, by making publication
of this Citation once in each
week for eight successive weeks
previous to the return day here-
of, in some newspaper published
in your county, to appear at the
next regular term of the District
Court of Pecos County, to be
holden at the Court House there-
of, in Fort Stockton, on the 8th
Monday after the 1st Monday in
August, A. D. 1913, the same
heing the 29th day of Septem-
ber, A. D. 1913. then and there
to answer a petition filed in said
Court on the 26th day of August,
A. D. 1912, in a suit, numbered
on the docket of said Court No.
887, wherein J. W. Weaver is
plaintiff and Joab S. Perry, and
the unknown heirs of Joab S.
Perry, deceased, are defendants,
said i>etition alleging in words
and figures as follows, to-wit:

of said Court:
Now comes J. W. Weaver,
plaintiff, in vacation, and files
this his first Amended Original
Petition in lieu of the Original
Petition herein filed July 26th.
1911, and complaining of Joab
S. Perry and the unknown heirs
ot Joab S. Perry, hereinafter
styled defendants, says:
1st
That plaintiff is a resident citi-
zen of Brewster County, State of
Texas; that the residence of the
said defendant, Joab S. Perry, is
unknown to him, nor doeshe know
the respective names and resi-
dences of the heirs of Joab S.
Perry.
2nd
That the said plaintiff is the
owner in fee simple title of 640
acres of land lying and being
situated in Pecos County, State
of Texas, known and described
as abstract No. 2988, survey
number Thirteen (13), in Block
No. 119. located by virtue of
Certificate No. 3300. issued to the
G., C. & S. F. Ry Co. That plain-
tiff derives his title to said prem-
ises as hereinafter stated in de-
tail under and by virtue of the
following described conveyances,
to-wit:
’A” Deed executed by R.
B. Neighbors, Sheriff of Pecos
County, Texas, dated June 5.
1900, and recorded Dec. 12th,
1900, in Deed Records of Pecos
County. Texas. Vol. 8, page 9,
conveying said premises to Frank
Rooney.
B” Deed executed by Frank
Rooney, dated Dec. 28th, 1908,
and recorded January 21st, 1909,
in Deed Records of Pecos County,
Texas, in Vol. 14, page 475, con-
veying said premises to plaintiff,
J. W. Weaver.
3rd
Plaintiff' avers further that he
is the owner of and in actual
peaceable, open, notorious and
adverse possession of said prem-
ises by good and fee simple title.
4th
That plaintiff, and those under
whom he claims, has had for
more than three (3) years prior
to the filing of the petition in
this cause, j^aceable,1 adverse
and continuous possession of the
said premiss under title and
color of title.
5th
That plaintiff, and those under
whom he claims, has had, for
more than five (5) years prior to
the filing of the petition in this
cause, actual, peaceable, open,
notorious and adverse possession
of all of said premises, cultivat-
ing, using and enjoying the
same, paying all taxes due there-
on, claiming under a deed and
deeds duly registered and re-
corded.
6th
That plaintiff and those
under whom he claims has had
and held, and how holds, peace-
able and adverse possession of
said premises, cultivating, using
and enjoying the same for more
than ten (10) years, prior to the
filing of the petition in this
cause, claiming the same under
written memoranda, of title,
other than deeds, the same being
duly registered.
7th
That the said defendants, by
and according to the Deed Rec-
ords of Pecos County, Texas, are
asserting, or pretending to as-
sert some right or claim of title
to the said premises.
8th
That the said defendants ought
not to have and maintain any ac-
tion or claim against the plain-
tiff for the premises above de-
scribed, for the reason that if
they, or either of them, have or
ever had any right, title, claim
or interest in and to said prem-
ises. then said right, title, claim
or interest can not now be as-
serted or maintained by them or
either of them by an action
against this plaintiff, because
said title, claim, interest or
right of action has long since
been barred by the Statutes of
Limitations of three (3), five (5)
and ten (10) years, all and each
of which statutes the plaintiff
pleads in bar to said claim, title,
interest and pretended claim,
title and interest of each of the
defendants to the premises.
Plaintiff' also pleads each and)
every of said Statutes of Limita-
tions as constituting and making
his good and perfect title to said
premises; that said tract of land
is reasonably worth the sum of
Five Thousand Dollars ($5,000).
and that the claim or pretended
claim or claims of the defendants
to the premises is a cloud upon
plaintiff’s title thereto, which
equity and good conscience re-
quire to be removed therefrom.

Wherefore premises consider-
ed, plaintiff prays for citation in
terms of law. as provided where
the residence of defendants are
unknowm, and in cases of actions
against unknown heirs; that up-
on hearing and proper proof
plaintiff have judgment against
the defendants and each of them,
removing the cloud cast on plain-
tiff’s title to the premises by the
claims or pretended claims of the
defendants thereto, and he be
quieted in his right, title and
possession of said premises; that
he have his judgment against de-
fendants for said premises and
for cost of suit and such other
and further relief, both general
and special, as he may be en-

dences of Joab S. Perry and the
heirs of Joab S. Perry are un-
known to me.

LOCATION
/BOUNTY SEAT of Pecos County, Southwest Texas, on
^ the main line of Kansas City, Mexico & Orient Railway.
Altitude, 3,050 feet. High enough to get all the benefits of
the dry, pure air, and not high enough to affect the nervous
system of the most delicate.
CLIMATE
The climate is unexcelled for an all-the-year-round place
to live. During the summer months, the sun shines hot
during the middle of the day, but the nights are always
pleasant. More sunshiny days than any other locality; no
hot or very high winds ; delightful winters; just a few cold
days in winter—open-window weather the year around.
Fine bathing pool, from flowing springs, 71 degrees, Janu-
ary or July.
HEALTH
No more healthful climate; no malaria or other local
cause to produce sickness.
WATER
Pure, clear and sparkling, from many springs, discharg-
ing 56.000,000 gallons daily. Also unlimited supply from
wells from 50 to 3(H) feet deep.
OUR PEOPLE
The population of Fort Stockton is 1.750. and of Pecos
County about 6.000; made up of the best citizenship from
many States. Fort Stockton occupies one of the finest lo-
cations for a city in Southwest Texas, and is the county seat
of the largest county in the State. Pecos County contains
5,536 square miles.
RANCHMAN AND FARMER
The mountains and plains are occupied by ranchmen,
who, as a rule, are as fine citizens as can be found in any
countv of any state. The irrigated sections are being set-
tled by an industrious, educated, progressive cla^s of people,
who have been attracted by our climate and rich soil. They
know how to farm and are pleased with their opportunities.
OUR HOTELS
Hotel Stockton, Rooney Hotel, Riggs Hotel and Coman-
che Hotel are all well kept and are nearly always full. But
there is great opportunity for investment in a fine resort
hotel, near the Government Spring, where the water is just
the right ternf>erature the year around for bathing. A good
hotel built on that site would attract guests both Winter and
Summer, as the weather is idea! in winter and the cool sum-
mer nights here are a delight to every one.
This is the finest site we have ever seen for the con-
struction of a lake, where fishing, boating and outdoor bath-
ing, every month in the year, would l>e a delight, and would
attract tourists from every climate and at all times.
OUR GRADED SCHOOL
Every community is judged largely by the interest man-
ifested by its citizens in the public free schools of that com-
munity. Our people are thoroughly alive to the importance
of education, and our Graded School, with seven teachers,
ranks well with schools of like character of any town in the
State. Our school building is comfortable, but, by reason of
the rapid increase in our scholastic population, we will soon
need more commodious buildings.
We have just voted an increase of 7 cents on the $100.00
valuation of the district, which is $5,500,000, which will pro-
duce $3,850.00 annually, and this will soon provide a sum
sufficient for additional buildings, for which there will soon
be imperative demand.
LOW RATE OF INTEREST
Almost the first thing that prospective buyers want to
know, is the rate of taxation, and we are glad to state, that
the rate in Pecos County, all told is only 91 fi cents on the
$100.00 of valuation. This includes state, county and school
taxes. Our county finances have been safely handled by
the Commissioners’ Court.
CHURCHES
Fort Stockton people are a church going people and are
liberal in their support of the churches. We have the Method-
ist, Baptist, Christian, Presbyterian and Catholic churches.
All the Protestant churches hsve Sunday Schopls. Ladies’
Aids and other societies for the promotion of religious
thought and training.
SOIL ANALYSIS
Our soil is a light grey adobe, with some gravel; in
places is a black sandy, very fertile. The depth varies from
18 inches to 5 feet, underlaid in many places with white clay
and in others with lime rock.
IRRIGATION
This is an irrigated district, having first been used for
irrigation in 1868, the ditches have been dug by the Mexi-
cans and the lands farmed by Mexican farmers. Today we
have 7000 acres in cultivation and water sufficient to irrigate
36,000 acres by natural flow; and as many more by artesian
and pumping wells. Irritation has been carried on here
successfully, without intermission, since 1868.
