Mueller crash
OPS officer Alvin Vaughn was the
focus of a KMOL interview last week
regarding the ongoing investigation
involving Bexar County Sheriffs
Deputy Charles Mueller. The deputy
was involved in an alcohol-related
accident in Medina County while on
duty.
County Attorney Maida Modgling
said the hospital records containing
the results of die deputy's breath test
had been subpoenaed.
Modgling said Vaughn's investiga-
tion was almost complete and he
would be submitting the case for re-
view soon. She will then decide
whether to press criminal charges
against Mueller.
"Currently we have a backlog of
criminal cases pending in my office,"
Modgling said."But this case will not
get any special treatment just because
it happens to be a high profile case."

day out of 1,40' students at the

pated in the Texas Music Educa-
tors Association Jazz Band au-

Hondo City Council
• Mayor Jim Barden presented
Hondo Water Department em-
plyees Robert Byerly, Felix Gonza-
lez and Ramon Lopez with the Em-
ployee of the Month award for
taking time off their weekends to
fix a problem with the water lines
at the Medina County Fair.
• The council approved the re-
quest of Carlos R. Martinez to re-
subdivide King Addition II on
1702 8th Street for residential
housing.
• Also approved was the request
of Silbiano Cuellar Jr. to replat
without vacating Lots 16, 17 and
18, Block 1, Mouer Addition on
Avenue J and 25th Street for resi-
dential housing.
• The council approved a request
from Power Cycles Inc. and Bonds
Inc. for a special permit to operate
an engine and motor repair shop on
Lot 7 and parts of Lots 8 and 9,
Block 16 on 1110 18th Street in the
Central Business District
• Bury and Pittman's request to
vacate and re-subdivide Lot 1-10,
Block 54 and Lotsl-5 and 9-10,
Block S3 for location of HEB on
20th Street from Avenue E to Ave-
nue H was approved by the city.
City Manager Scott Wall attributed
the numerous re-zoning requests
the city had received to the eco-
nomic growth that Hondo was ex-
periencing.
• The council authorized Wall to
pay Medina Community Hospital
for Wellness Center equipment.
The authorization was approved
previously but contingent on the
condition that it would not jeopard-
ize the center’s ability to receive
Medicaid and Medicare funds.
• The council approved $13,500
for an amended contract with Bex-

• The council approved the pur-
chase of a $10,725.50 Toshiba
copy machine for the city. Three
other bids were received end city ^
employees had the opportunity to ■
test the different machines and de- -

• A $5,000 expenditure was ap- '
proved for domestic violence and
rape services for the fiscal year
1996-97. a
• The city approved an agreement
with the Medina County Museum
for a 12 percent hotel occupancy
tax allocation to support the mu-
seum. a *
• The city heard a harassment
complaint from T.A. Lopez against
an HPD officer (see related story).
Castroville City Council
£8 FURNITURE CENTER a
Under the recommendation of
City Attorney Vivian Torres, the
council decided to remove from
the agenda a motion to drop the
Castroville News Bulletin as its of-
ficial newspaper.
“After much research and since
now we have a new administrator,’’
Mayor Dwight Green said, “we
will make an effort, if the newspa-
per will, to be more open.”
The motion to drop the newspa-
per appeared on the agenda at a
September 10 meeting and had
been tabled since then pending rec-
ommendation from the city attor-
ney.
The mayor and council had ac-
cused the newspaper of being
slanted and negative in its cover-
age and unfair to former city ad-
ministrator James Fisher. The
News Bulletin, in turn said that the
city was uncooperative.
Sammy Tschirhart addressed the
council with a grievance that alle-
gations were brought against him
in an executive session in his ab-
sence that he had been involved in
an illegal transaction. He said the
allegations revolved around 12 to
16 hours of work that was author-
ized by former Fisher in exchange
for free rent.
“I do not appreciate accusations
being brought against me in execu-
tive session that would cause harm
to my name and reputation,’’
Tschirhart told the council. He
said he expected an apology from
the mayor and the city council.
Green said that the matter was
raised during an evaluation on
Fisher’s personal performance
held in executive session, but no
wrong-doing on Tschirhart’s part
was questioned. “Council never
said Sammy did anything improp-
er,"Green said. “At no time did
this council ever question his cred-
ibility. Unfortunately, we cannot
apologize for public gossip, and
that was what it was.”
• Joe Middendorf, a retired Cas-
troville businessman said he was
“ticked off’ that he was charged
60 cents for the minutes of the pre-
vious city council meeting. The
mayor explained that the 20-cents-
per-copy charge was standard and
necessary as a safeguard against
costs the city would incur should a
newspaper request copies of docu-
ments that involved hundreds of
pages.
Middendorf also raised com-
plaints that the city had been over-
spending and that he had been “in-
timidated” by previous councils
but not the present one. He told
council that he w xild be attending
their meetings on a regular basis.
• The council voted to hold a
public hearing on a $75,000 rebate
received from City Public Service
and on a 20-year agreement that
CPS has offered the City of Castro-
ville. The hearing would be held
Monday, October 28 at 7 p.m.
• The council voted to approve
one-way traffic at Village Path
from Country Lane tb Sunnyland
between 5 to 8 p.m. on October 31
to accomod te the heavy Hollow-
een traffic. Council voted not to
enact official Trick or Treat hours,
saying that the city’s curfew was a
sufficient check to any mischief.
The entire police force would be
on duty Holloween night.
• The council approved sending
City Administrator Marcie Mora to
Richardson, TX, for a three-day
seminar at an estimated total cost
of $1,300.
• The council approved a new
computer at an estimated cost of
$26,000 for the Public Works De-
partment. The computer was re-
quested by Director of Public
Works Ben Ruston Jr.
