Suit filed against officer,
gas station attendant
By Linda A. Rodriguez
Suit has been filed in
district court by Mnrcelino
Correa against Samford
and Sons Exxon, employee
Bob Barnett and Mack I).
Wilson, Hondo police
officer.
Correa claims that on
March 12, 1978, he pur-
chased $9.80 worth of gas
from the station, Barnett
attending. Correa offered
cash to pay for his bill, but
Barnett refused it, claiming
that he did not have e{tough
change. Correa says he told
Barnett that he was going
out of town and would pay
the bill when he returned
Barnett agreed.
Correa claims that Bar-
nett later reported ' the
incident to Hondo Police as
a theft. On March 16, when
Correa had returned from
his trip, Officer Wilson
arrested him.
Correa claims in his suit
that he “was stopped on a
public street in the pre-
sence of many other per-
sons as Defendant Mack D.
Wilson and others of the
Hondo Police Department
forceably and unlawfully
seized Plaintiff, physically
pushed, shoved and jerked
Plaintiff, handcuffing him
and taking him to jail"
where he was “forceably
and unlawfully detained
and imprisoned."
Correa later went to
Samford and Sons on
March 18, offerihg payment
of the amount he owed. The
gas station demanded pay-
ment in the amount of
$10.00. The complaint filed
in the Magistrate Court by
Barnett and Mack Wilson
was then dismissed bn
April 10.
Correa claims that the
actions of the defendants
constitute malice because
he fully intended to,pay for
the gas and had agreed
upon a manner of payment
with Barnett. He also
states in the suit that he
was “humiliated, embar
rassed, shocked and ag-
grieved, he suffered great
and lasting mental anguish,
and his good name and
reputation has been irre-
parably harmed in the com-
munity, ...and (he) ..incur-
red reasonable attorney
fees...1'
Correa's suit asks for
exemplary and punitive
damages, attorney’s fees
and court costs.
