New York August I The Paris corre
tpandent of the Tribune discussing tho
quostlns on which the coming Dreyfus
ecurt martial will hinge says Ono of
the consequences of the Judgment deliv
ered by tho court ot cassation on June 3
has been to shift the burden of proof
frcm the prisoner to the prosecution At
tho court martial of 1S34 It was Incumbent
upon Captain Dreyfus to provo that he
was Innocent of tho charges brought
against him This was In accordance with
French law which places tho burden ot
proof uptn the accused Dut at the Ronnes
cturt martial Captain Dreyfus will appear
as an officer who has been Illegally con-
demned and will not bo obliged to prove
his Innocence It will bo for tho prosecu
tion to provo that he Is guilty The Issue
relegated by tho court of cassation to thi
Ronnes court martial for trial Is narrowed
down to tho single question whether or not
Captain Dreyfus communicated to a for-
eign power tho documents enumerated In
tho brdcroau The bordereau Is tho mem
oranda without date or signature written
on very peculiar watermarked tissue pa-
per which upon the evidence of tho Into
Colonel Henry the former was torn In
slips and thrown In the waste basket ot
Col ncl Schwartzkoppen then military at
tache at the Germany embassy In Paris
and nfter being put together by Colonel
Henry formed tho basis of the original
changes against Captain Dreyfus Thero
Is nothing ln the bordereau to show that
Dreyfus had anything to do with the
treasonable practices or to connect him
in any manner with It beyond an alleged
similarity between the handwriting of
Dreyfus and that of tho author of tho
bordereau The court of cassation has
decided that the bordereau was written by
Esterbnzy and not by Dreyfus
The court of cassation has already
passed Judgment on all the other evi-
dence against Dreyfus ln 1894 Including
the confession of guilt falsely alleged to
have been made by Dreyfus In January
1S95 to Captain Le BrunRenault and to
Sergeant Depert us well as the famous
secret dossier with Its forgeries and crim-
inally manipulated documents All that h
legally loft standing after the elimination
by the court ot cassation of the Irregulari-
ties that vitiated tho conviction of 1891 Is
the bordereau which tho court of cassa-
tion on June 3 declared was not written by
Dreyfus
The functions of the Ronnts court mar-
tial are now limited to hearing evidence
and deciding upon tho subject ot the al-
leged communication by Captain Dreyfus
to a foreign power of the documents
enumerated In the bordereau now known
had been issued at Chalons and elsewhere
lor tho use ct officers during tho man
euvers giving descriptions with litho
graphs of four of the Ave subjects re
ferred to In the bordereau and as to tha
note abaut tho Madagascar campaign It la
notorious that the plans ot that campaign
were discussed ln council ln no less than
four different meetings and that over 600
different Individuals in Tarls wero fully
tognlzaht of lis details
he prosecution succeeds In proving
that Captain Dreyfus handed over to a
ireign power nny one of tho flvo docu
ments mentioned In tho bordereau Capraln
Dreyfus must bo condemned as n traitor
and transported back again to Dovlls Is
land If on tho contrary and this semms
now almost n ccrtalnty tho prosecution
fall to establish that Captain Dreyfus de
livered any of tho five documents to a
foreign power he must bo ncqulttol
General Do Oalllfct minister of war has
Issued Instructions to Major Carriers gov
ernment commissary at the Hennes court
mar lal to insure that tho court martial
shall not Invalidate Its own future de
cisions by deciding Upon matters not In
volved In tho Immediate Issue These In
structions simply pin the court martial
down to the bordereau and at tho same
time leaves the prstecutlOu the utmost
freedom as to tho methods they may sob
fit to use ln order to provo their case
