being propelly and fairly tiled be
fore said grand tribunal and its Judg-
ment should therefore be and Is void but
said tribunal rendered a Judgment to ef-
fect thnt plaintiff was guilty and Instructed
the defendant lodge to procecJ to either
eptl or suspend from said defendant
ledge which said defendant lodge had
failed and refused theretofore to do on

This plaintiff further says he Is Informed
and believes that said purported statute
of the Grand Lodge is unreasonable and
void that same Is also contrary to the
laws of Texas providing against trusts
and conspiracies against trado nnd Inso-
far ns defendant lodgo recognizes same
and assents to same and proposes to act
upon same same is a combination of acts
of two persons and more than two per
sons associated together in said difendant
lodge to create and to carry out restric-
tions in tho free and full pursuit of a
business authorized and permitted by laws
of this State and is therefore void that
plaintiff Is now and has been during the
tlmo of said trials aforesaid engaged in
tho saloon business a3 a retail liquor
dealer in the city of Hlllsboro Hill coun-
ty Texas paying all taxes Federal State
county and city therefor That said pur-
ported statute of said Grand Lodgo also
deprives plaintiff of his right as aforesaid
In said defendant lodge If said defendant
lodgo undertakes to carry out said ordpr
that some of the members of said lodge
and he believes and avers a majority of
members of said lodge acting as a lodge
now threaten nnd aro about to procoed
either to suspend or expel plaintiff from
said lodgo in obedience to the nforeaild
Judgment of said grand tribunal and
thereby deprive plaintiff of his rights of
membership his Insuranco as aforesaid
and threaten to carry out said restriction

freely pureuo his occupation and business
as such saloonkeeper and retail liquor

such action would be Irreparable Plain-

Its place on tho boards having been taken
by tho police and fire commission At
last evenings meeting of this board there
were no applicants present to bo oxamlned
and the session was resolved into an in
vestigating committee
John Felgel nas before tho board in re
sponso to a summono Replying to ques
tions he testified that ho had been elected
a supernumerary fireman in 1S97 Ho said
ne bad gotten on an average about two
days work a month in tho department
and was not
serving at present because he
could sot no work He said tho last work
ho had gotten was about fhe months ago
ono cold night Ho also told the board
about disposing of hlg time for this one
night at a store Ho was asked a good
many questions about it but he got to the
point whoro ho declined to answer fur
thor and Mayor Jones Informed him that
ho had a right to swear him and tho right
to compel him to answer questions Ho
told him that he would regret very much
to havo to send him to Jallt but would bo
obliged to do if he did not answer
Mr Felgel refused to answer or to bo
sworn and tho matter was compromised
by his assertion that what ho had hith-
erto stated was true

Tho negro editors of tho State will hold
a meeting at Dallas on August U for the
purposo of organizing a colored pTess as-
sociation Efforts havo been made hereto-
fore to form such an organization but
havo novcr been successful on Ing to the
scarcity of material to work on There
aro now however about twenty negro
newspapers in Texas and tho editors of
tho leading ones feel that an association
that will last can now bo formed

nected movement on the part of the negro

E Ballard a saloon keeper seeks to pro
vent tho Knights of Pythias lodge from
suspending or expelling him on nccouat
of hl business Mr Ballard alleges that
he affiliated with the order in4S90 and in
1S03 took out a policy In the order for
2000 and that on tbo 17th day of April
1S95 a purported rule regulation or rather
what Is called a statute of the Grand Lodge
went Into effect whon plaintiff was a
member In go d standing nnd holding the

said purported statute providing that auy
member of the order then engaged In tho
occupation known as saloonkeeper or bar
