open letter was handed out by the depart-
ment of agriculture Insurance statistics
and history this morning
Tj the Officers and Managers of Insurance
Companies Doing Business In the Stato
of Texas
Gentlemen The attorney general Is the
legal adviser of this department Ho baa
construed tho overhead Insuranco act to
mean that a local agent regularly appoint
od may write business anywhero In tho
Stato by paying tho required tax This
construction leaves nothing over the over-
head Insuranco law except that It prevents
companies authorized to do business In
the State from writing contracts of Insur-
ance except through agents regularly ap-
pointed and rcsldont In tho State
This department will follow the Instruc-
tion of the attorney general In answer to
our request that ho construe thb law We
quote from tho attorney generals letter
to us as follows
So long as tho companies comply with
the law In the Issuance of the policy
through their regularly licensed and com
lnlssluncd local agents in Texas they do
not incur the penalty denounced by the
statute and it is immaterial whether the
