News has been received of a favor-
able decision in the case of E J Spen
cer et al vs the City of Palestine suit
to recover forfeit money and asking
damages against the city This case
had been appealed to the court of
civil appeals at Galveston after the
city had won its case in the lower
court
This suit w as brought by Appel
lants E T Spencer and J S Trittle
against the City of Palestine as a

Palestine on January 12 1903 one of
which franchises was condition that
appellants place in the hands of the
mayor or some person designated by
the mayor 1000 to be forfeited to
the city as liquidated damages in the
event appellants failed to commence
work of huilding a street railway sys
tem within sixty days from the grant
ing of the franchise
It will be remembered by those who
kept up with the history of this case
that the city extended the time grant-
ed to begin work on the street rail-
way and that at one time the fran-
chise holders just before the expira-
tion of the last extension of time
granted placed or caused to be
placed three trolley poles on a cer-
tain street and claimed that under
the franchise they had commenced
work and were therefore entitled to
their forfeit money In addition to
suing for this forfeit money the par-
ties plaintiff sued for the value of the
franchise which they placed at 5000
and for the additional sum of 37925
