Arbitrations Scheduled
Some growers who applied “Strongarm,” a herbicide developed by Dow
AgroSdences to better incorporate cotton/peanut rotation programs, believe
that they may have encountered unforeseen problems during its first year on
the market While the chemical worked fine in many fields, several producers
believe that the product caused yield reductions. Producers using pre-
emergent applications seemed to suffer the most damage.
Dow AgroSciences currently believes that extreme early season
temperature variances, high soil pH, low organic matter and cool soil
temperatures due to additional pre-emergency waterings caused by excessive
early season drying winds are possible causes of the yield loss some growers
experienced.
Several growers who believe they have damage claims have contacted
Western Peanut Growers (WPGA) asking for information on Dow
AgroSciences process for resolving claims. WPGA contacted area Dow
AgroSciences Representative Greg Alpers for information to help answer the
questions.
Alpers provided the following information:
-Through the Texas Agricultural Extension Service, Dow has tested
"Strongarm” on the South Plains the past seven years. These tests did not
reveal the types of problems that have arisen this year;
-Dow Agroscienoes is working with retired Extension Service specialists
to investigate and evaluate the claims;
-Growers who contacted the company early in the growing season have
had Dow representatives and consultants inspecting their crops throughout
the year;
-Dow will be using a neutral, third party mediator to help with resolving
Claims;
-A questionnaire packet has been distributed to growers who have made
claims. These questionnaires are to be completed and returned before the third
party arbitrator can review each case. Dow anticipates that these growers will
have an opportunity to appear before the mediator to present their case,
possibly as soon as mid-January;
-The arbitration process may be delayed because many growers do not
have final yields as a result of poor harvest conditions this fall; and
-It will be very difficult for producers to prove chemical damage if they
did not contact Dow AgroScienoes to inspect fields before the harvest season.
Alpers said, "Legitimate claims will be resolved in a manner that will be both
fair to the producer and to the company.”
Disaster Payment Limitation
On Dec. 21, USDA sent state and county FSA notices stating "the 2000
Crop Disaster Program will limit ‘persons’ to an $80,000 payment limitation
for the program."
Rules for the peanut portion of the disaster program are expected to be
released at any time. Although rules, forms and software have not been
distributed, signup for the program is scheduled to begin Jaa 18,2001.
WPGA anticipates that local FSA offices will distribute newsletters
containing the information, once it becomes available.
2001 Quota Poundage
On Dec. 13, USDA announced the national quota poundage for peanuts
for the 2001 marketing year will remain at 1,180,000 short tons (2.360
billion pounds), the same as the 2000 level. This figure excludes seed quota
and has made allowances for the possibility of underdeliveries up to 17,000
short tons.
The national average 2001 quota price support level is set by statute at
$610 per short ton. The price support level for additional peanu’s must be set
by Feb. 15.2001.
Peanut Marketing Assistance
All peanut producers who have an interest greater than zero for the 2000
crop year will be eligible for PMAP compensation. Additional peanuts will
receive $16 per ton (up from last year's $8.75) aid quota peanuts will receive
$30.50 per ton.
Producers mist be through marketing their 2000 crop peanuts and return
their “Smart Cards” to FSA offices before applications can be filed. Signup
for the PMAP will continue through Feb. 1,2001.
Annual Meeting
Western Peanut Growers will hold its annual meeting Monday, March
12,2001 si the Gaines County Civic Building in Seminole. Announcements
and additional details will be forthcoming in earlv March.
