FROM THE STATE CAPITAL
Dallas Light Artillery Kas Not
Guilty of Insubordination
BUT NEITHER SIDE WAS SUSTAINED
Civil Action Against tbe VTatenrierce
Company Still Contemplated Char
lira rilrdtand Sales Ruling
Austin Texas January 7 Lieutenant
Colonel R K Gaston Lieutenant Colonel
E A Stuart MaJjr A Harrlsjn and
Major G W Foster composing the board
of lnqui t appointed by Adjutant General
Mabry to Investigate the charges flltd
against battery b Texas Volunteer
Guard of Dallas by Captain A J Hous-
ton an 3 thfc counter charge filed against
the Utter by members of tho battery have
made their report
The charges and counter charges grew
out of tho alleged refusal of battery B to
turn out and fire a salute In honor of
Governor Culberson
The board recommends that the charges
of Insubordination and conduct to the
prejudice of good order and military dis-
cipline made by Captain Houston against
certain members ot battery B bo not sus-
tained except as affecting C C Welchsel
on the latter count
As Wetrhse disclaims membership In
the volunteer guard by reason ot having
never subscribed to tuo oath of service
and denies any moral obligation to per-
form the duties of a soldier except as It
pleases htm and says ho would plreid non
membership against any sentence the ad-
Jutant general should Impose upon him
for breach of military discipline etc the
board la at the opinion that lie should be
discharged from the Dallas artillery com-
pany and If within the power of the
adjutant general prevented from securing
a membership In tho Texas Volunteer
Guard
ThB board also finds that the vote of
the company not to turn out was not sa
taken on account of unwillingness to fire
a snluto to the governor that a court
martini Is unnecesary and that tho
charges against Captain Houston are not
sustained
Finally It Is the boards opinion that
the trouble arose out of the fact that the
parties to the eontroversy mlsurdetstood
each other and that whllo bath sldis
erred on severs counts they did no not so
gravely as to require punishment but
still in a manner sufficiently serious to bo
deplored by persons having In view the
host Interests of tho State rallltla
