minds of the nubile as to who fired the
shot which oventuatod ln the death of
William Stepney but such doubt as may
havo existed has been removed by a state-
ment mudo by Police Officer John Cooper
to Chief of Police Jones as follows
Wednesday night between 11 and
1115 oclock I was standing on Twenty
seventh street and Avenue 11 watching
for a man who Is wanted by the pollco
on a chnrge of assault to murder Pres
ently I saw a man corns along the side
walk whom I mistook for the man for
whom I was looking I commanded him
to halt but ho did not heed my order
Again I elled to him to stop but ho
paid no attention to mo It was then
that I pulled my revolver and tired a shot
at him and shortly after bred again
When I shot I did not shoot to kill 1
pointed high and calculated that both
bullets would pass over tho mans head
I was greatly surprised when I saw tho
man fall The shooting was purely nn
accident The ground upon which I was
walking at a pretty lively gait In order
to catch up with the mun was very un-
even and when I Hied the second shot
l must havo stepped ln a hole my hand

Officer Cooper told his story tho chief
