Don’t drink before making a
will, either. If you do, you are
opening the possibility that some
distant day, the document may
be held null and void in a court-
room.
Of course, intoxication is a
matter of degree. A man who
fortified himself with a couple
of drinks, but then proceeded
to discuss and sign his will with
obvious understanding of what
he was doing, was held to have
made a valid will.
What concerns the law is the
man who is too intoxicated to
exercise judgment. For then
the document he signs does not
truly express his “will” at all.
The crucial time is the mo-
ment of signing.. Even a chron-
ic alcoholic may make a valid
will if he executes it during a
sober interval.
Tougher problems arise in the
case of drugs. Not infrequent-
ly, a person makes his will
while under treatment for a
serious illness. Drugs he is tak-
ing, particularly the painkillers
may have side effects that low-
er his testamentary capacity,
at least temporarily.
As a rule, mild side effect!:—
perhaps some anxiety or eu-
phoria—will not invalidate a
will. Thus, a court upheld a
will made by a heart patient
a few hours after taking a dose
of narcotic drug. The court
pointed out that, while the
dosage may have made him
sleepy or slowed his reactions,
it did not rob him of his essen-
tial awareness of the proceed-
ings.
Can anything be done if a pa-
tient is receiving such strong
sedatives, or such mind-distort-
ing drugs, that there is real
doubt of his ability to make a
win?
One possibility, in such cir-
cumstances, is to ease up temp-
orarily on the medication—pro-
vided, of course, that this is
medicahy justifiable.
Another possibihty is to pre-
pare the will in relatively sim-
ple form. This may help to con-
vince a court, later on, that the
patient was able to comprehend
what he was signing.
On the whole, the law win
bend over backwards to hold a
win good. Better to give reas-
onable weight to the testator’s
intentions, imperfectly express-
ed, than to give them no weight
at all.

Commissioners’ Court
Proceedings
County Commissioners this
week ordered the permanent
school funds, in the amount of
$1,168.79 be prorated to differ-
ent schools in Grayson County
at the rate of seven cents per
capita, according to the 1967
census rolls.
Other county business trans-
acted included:
Accepting $2750 from Lone
Star Gas Company for rental
on a line across Carpenter’s
Bluff Bridge and approved a
contract for $150 per year rent-
al beginning in 1972;
Appointed Wanda Lankford as
official court reporter for the
county court at a salary of
$3,720 per year;
Appointed W. E. Badgett to
act for the county as agent for
the Master Plan for the Gray-
son County Water and Sewer
Committee;
Accepted an ordinance of the
City of Denison extending City
limits to annex land around Whitesboro area until the next
Hyde Park to aid in establish- general election.
