That of the defendants above nam-
ed, if the residence of such of them
as named above is untrue, then the
residence of such is wholly unknown
to the plaintiffs.
That the plaintiffs herein are the
ed, together with all mineral rights
in, on and under the same, on the fol-
lowing described lands situated in
Pecos County, Texas, to-wit:
That plaintiffs are the owmers in
fee of Surveys Nos. 5, 7, 9, 17, 21 and
29, in Block 12X, T. & St. L. Ry. Co.,
and Surveys .T, 5, 7, 11, 13, 15, 17, 19,
21, 23. 25, 29. 31, and N.H 33, in
Block 129, T. & St. L. Ry. Co., and
Survey 24. in Block No. 130, E. F.
Wakefield, and Survey 12, in Block
No. 130, L. M. Estes, all in Pecos
County, Texas, and also the following
lands in Terrell County, Texas, Sur-
veys 3, 15 and 25. in Block No. 12H,
T. & St. L, Ry. Co., that plaintiffs
and those under whom plaintiffs de-
rain title have held said lands for
more than five yegrs next preceding
the filing of this suit, using, occupy-
ing and enjoying adversely, peace-
ably and continuously, rendering and
paying the taxes on same each year
as they accrued; that defendants, not-
withstanding all this are claiming and
asserting some interest in and to said
lands, and without plaintiffs’ know-
ledge or permission, have executed
certain instruments of writing affect-
ing title to said lands, and that the
instruments under which defendants
claim are spurious, fraudulent and are
not genuine; and acting under such
instruments defendants have executed
muny conveyances to divers persons
whose residences are unknown to
•ilaintiffs and that such persons have
had and are having same recorded in
Pecos County, Texas, thereby creating
a cloud on plaintiffs’ title to said
lands; and that the plaintiffs believe
defendants will continue to execute
other instruments and have same re-
corded and in this manner further be-
cloud plaintiffs’ title; that such cloud
will keep plaintiffs’ from selling their
oil and gas rights in said lands; that
plaintiffs have been damaged in the
sum of $50,000.00; that they have no
adequate remedy at law; wherefore
plaintiffs pray the Court to grant
them a most gracious writ of injunc-
tion against H. L. Winfield, County
Clerk of Pecos County, his deputies
and successors, restraining them from
filing any more of such instruments
executed by defendants and their as-
signs. which will affect the title to
said lands; and that the Court will
declare such instruments aforesaid to
he void and of no force and effect and
that plaintiffs' may have damages
against said defendants in the sum of
$50,000.00, cost and attorney’s fees.

You are hereby commanded to sum-
mon George G. Bradley, by making
publication of this citation once in
each week for four successive weeks
previous to the return day hereof, in
some newspaper published in your
county, if there be a newspaper pub-
lished therein, but if not, then in any
newspaper published in the 83rd Ju-
dicial District; hut if there be no
newspaper published in said Judicial
District,'then in a newspaper publish-
ed in the nearest district to said 83rd
Judicial District, to appear at the
next regular term of the District
Court of Pecos County, to be holden
at the Court HottM thereof, in Fori
Stockton, on the 1st Monday in Sep-
tember, A. D. 1921, the same being
the 5th day of September, A. D. 1921,
then and then- to answer a petition
filed in said court on the 30th day of
May. A. 1). 1921, in a suit, numbered
on the docket of said court No. 1457,
wherein Garrett J. Van de Berg is
plaintiff, and George G. Bradley and
Ben Van de Berg is defendant, and
said petition alleging that on or about
January 1st, 1921, plaintiff was law-
fully seized and possessed of the fol-
lowing described land, and premises,
situated in Pecos County, Texas, hold-
ing and claiming same in foe simple,
to-wit: Section No. Six (6), in Block
No. 11, Cert. 8-1603, H. & G. N. Ry.
Co. grantee, containing 640 acres of
land, more or less.
That on the date last aforesaid defen-
dants entered upon said premises and
ejoeted plaintiff therefrom and un-
lawfully withholds from him the pos-
session thereof to his damage in the
sum of $2,090.00; that the reasonable
annual rental value of said land and
premises is $2,000.00.
Prays for judgment of the Court,
for citation, and for judgment for the
title and possession of said described

of Fort Stockton, Texas, convened in
regular session at its regular meet-
ing place in said city, all members
thereof, to-wit, Hon. John M. Roon-
ey, the mayor, and aldermen, R. E.
Ellis, Geo. B. Pace, H. C. Petty, T. C.
Rodgers and E. W. Bennett, and W.
H. Bird, city secretary being pres-
ent, among other proceedings hud
was the following, to-wit:
It was moved by alderman H. C.
Petty and seconded by alderman T. C.
Rodgers, that there be submitted to
the qualified voters of the said city,
who are property tax payers therein
the proposition for the issuance of
the bonds of the said city, in the sum
of seventy-five thousand ($75,000.00)
dollars for the purpose of voting upon
the question of the issuance of bonds
of said city of Fort Stockton, Texas,
for the purpose of construction of
water works within the limits of saic]
city, the election to be held on the 17th
day of September, 1921, the motion
carried by the following vote:
Aldermen R. E. Ellis, Geo. B. Pace,
H. C. Petty, T. C. Rodgers and E. W.
Bennett voting AYE and none voting
NO.
Thereupon the following ELF^C-
TION ORDER was adopted:
Whereas, the City Council of the
City of F'ort Stockton, Texas, deems
it advisable to issue bonds of the said
City of F’ort Stockton, Texas, for the
purpose hereinafter mentioned:
Therefore, be it ordained by the
City Council of the City of Fort
Stockton, Texas, that an election be
held on the 17th day of September,
1921, at which election the following
proposition shall be submitted:
“Shall the City Council of the City
of Fort Stockton, Texas, be author-
ized to issue the bonds of the
City of Fort Stockton, Texas,
in the sum of seventy-five
thousand ($75,000.00) dollars, pay-
able forty (40) years from the date
thereof, with option of redemption at
any time after ten (10) years from
their date, bearing interest at the
rate of six (6 per cent) per cent per
annum, payable semi-annually, and to
levy a tax sufficient to redeem them
at maturity, for the purpose of con-
struction of water works within the
city limits of said City of Fort Stock-
ton, Texas, as authorised by the con-
stitution and laws of the State of
Tessa-'
The said election shall be held at
the Hadden Building, new need as
city hall, across from the First State
Bank on Stockton street, within the
city limits of said City of F'ort Stock-
ton, and the following named persons
are hereby appointed managers and
clerks of said election, to-wit:

The said election shall be held un-
der the provisions of House Bill No.
42 of general laws passed at regular

1921, and the constitution and laws
of the State of Texas, and only quali-
fied voters, who are property taxpay-
ers of said city shall be entitled to
vote.
All voters who favor the proposi-
tion to issue the bonds shall have
written or printed upon their ballots
the words:
“For the Issuance of Bonds.**
And those opposed shall have writ-
ten or printed upon their ballots the
words:
“Against the Issuance of Bonds.**
The manner of holding said elec-
.ion shall be governed by the laws of
the Sti** of Texas regulating general
elections.
A copy of this order signed by the
mayor of the City of F'ort Stockton,
attested by the city secretary of the
said city, shall serve as a proper notice
of said election. ,
The mayor iR authorized and direct-
ed to cause said notice of the’ election
to be posted up at the place used as
the city hall of said city, to-wit, the
Hadden Building on Stockton street,
and at one public place at the vot-
ing place of the city to-wit, the said
Hadden Building on Stockton street,
in front of the First State Bank, ana
at two other public places in said
city, for at least thirty full,days prior
to the date of said election.
The mayor is further authorized
and directed to have said notice of
election published in some newspaper
of genera] circulation published in
said city, and which notice shall be
published once each week for four
weeks, the date of first publication
being not less than thirty full days
prior to the date of the election.
