describe the increased feeling of cheer
fulness existing here today cs a result
of the railroad mass meeting held last
night and the determination of the people
to levy a voluntary tax to create a rail-
road fund As has been stated the
pledges made last night at the meeting
aggregated over S7500 uad the com-
mittee of fifteen estimate that at least
25 000 can be raised within ten days by
this means The committee held a meet
ingtonight and mapped out a full Hue
ol work for nest week in the way of get-
ting pledges based on the assessments
The action of the Crawford people yes
terday in getting up a project to build a
tap road to Waco a distance of eighteen
miles will meet with a hearty second

last Monday About 3 oclock this morn-
ing Jailor Kethley noticod three strange
men hanging around the jail Then
the strangers went away and rein-
forced their numbers and came back
but the jailor had also summoned help
and was ready for any emergency but the
attack was not made There is no doubt
but the stranger intended to get Gardner
by force or otherwise as they had de-
manded him of the United States mar-
shal yesterday Gardner speaks freely
of the killing He says Hutchison told
him he was ready to settle their f us3 and
told him to dismount and was doing tho
same himself when Gardner reached
over his horse and killed him

tect arbitrators W H Wilson of Dollas
and Eugene G Heiner of Houstontoday
reported as follows After carefully ex-
amining the courthouse and the plans and
original specifications they award to said
P J Loonie the sum total of the origi-
nal contract S8C00 and the further sura
of S1G8S 85 on supplementaljcontract for
blinds less amounts already paid
They find the building is except
in a few minor details built according to
plans and specifications but work having
been done and material furnished in ex-
cess thereof to more than offset any dif-
ference therein they lurther agree and
so award that P J Loonie be charged
nothing on account of noncompletion of
the building in the short time allowed
him by said contract as said
contract was not sufficient
to properly complete said building
They further find the building worth
more than the contract sum awarded
and say that a fair contract price would
have been about 53000

brought by appellees to recover an indi-
vidual bal interest of two sections of
land which P T and M V Adams
owned and located in 1875 March 1
1876 P T and M V Adams transferred
the certificates by proper conveyance to-
W C Adams to whom the land was pat-
ented in 1880 but the conveyance of the
certificates was never recorded ex-
cept in the land office In 1877

brought an
action against P T Adams and under a
writ of attachment the land was sold and
bought in by appellee who or his father
knew nothing of the unrecorded convey-
ance of the certificates to W C Adams
The statute says thac an unrecorded con-
veyance shall be void as to all creditors
and subsequent pufchasersand the statute
does not make the filing of a deed in the
Land Office sufficient The judgment is
affirmed

Gaines A J This suit was as to the loca-
tion of the Moses F Baker league ap
pellees claimingthat its east boundary is
the Gaudalupe river while appellants
claim that it is a certain slough or old
river bed the land in controversy lying
between the river and slough The field
notes of the Baker grant call for the river
but the courses and distance do not cor-
respond to the meanders of the stream
The evidence shows that the calls very
nearly correspond with the configuration
of the slough and one witness testified
that when the river is high it is hard to
tell the slough from the river In view of
these facts the court erred in withdraw-
ing from the jury the question whether
the east boundary as oiiginally run ex-
tended to the river or the slough and for
this the judgment is reversed and the
cause remanded

this case is whether the right of home-
stead was lost by appellees in property
which they lived in for a long time but
temporarily rented out The question
was to be decided by the jury whether
appellees indicated their intention no
more to use the lot for

There was not sufficient evidence to show
the homestead right was abandoned and
the judgment Is affirmed

precisely the same facts as Sowell vs
Jones decided a few days ago The
pleadings and judgment below were the
same For the reasons expressed in that
opinion this judgment is reversed and the
cause remanded

an insurance upon his dwelling with ap
pellee upon the condition that if any
change in the title took place without the
consent of the company the policy would
be void Subsequently with the consent
of the company he transferred the policy
to appellants to secure a debt as collat-
eral security which was already se-
cured by a deed of trust At a still later
date he executed a warranty deed to
Elizabeth Strickland of which the ap
pelles company had no notice
until the house was consumed by tire In
the suit on the policy appellees set up the
defense that the sale violated it and the
court sustained It is sought by ap-
pellants to bring this in a line of
decisions holding the policy as valid but
most of the authorities cited as support-
ing such a theory obtain under a different
state of facts viz the transferee of the
policy assumes the payment of all the
assessment made upon the 1 policy the
practice beincc to require those insuring
their property to give notes for the
premiums due and to become due and in
the cases referred to the transferee either
assumes those notes or rendered himself
liable by adding his signature thereto
In this case such is not the fact the
company merely agreed to pay the appel-
lants who gave no consideration to it on
their pirt provided all the conditions
were complied The insured mortgagor
continued to pay all the assessments and
everything remaiiled in statu quo except
the transfer of the policy There have
been some decisions supporting the view
of the case relied on by appellants but
they have bean mostly overruled The
judgment is affirmed

assignment under the strict construction
on them by the statutes of other states

senger a blacksmith at Lloyd twelve
miles east of here mysteriously disap-
peared last Wednesday evening and has
not been heard of since It
is feared tnat he has become insane and
Is wandering in the bottoms or perhaps
taken his own lie He had been sick for
about a week and had been acting some-
what strangely and had concluded to go
to a physician wno lived a few miles
away to get some medicine telling his
wife that he would be back that eveninc
unless he was feeling t o bad As he did
not return that nignt search was instituted
for him the next morning and it was
found that he bad not gone to the physi-
cians house and diligent search by the
whole community up to tbia date has
failed to disc ver any trace of
him He was a man about
thirty years old six feet high having a
dark sandy muatache and left without his
coat He had been in this county several
years and was married last January to a-
very nice lady who is almost distracted
over hi3 sad and mysterious disappear-
ance Mr Messengers father lives at
Graham Young county Tex There
seems however to be no suspicion that
he has ieft Ihe country but the belief is
that his ramd has become impaired and
that he is secreting himself in the brush
of Elm bottom
