substantially as follows, to wit:
This is an action brought as well
to try title as well as for damages
wherein plaintiffs allege that they
are the owners in fee simple of the
following described land and prem-
ises, to-wit: All that certain lot or
parcel os land situated in Red
River County, Texas, in the town
of Detroit, Texas, and described
as follows: BEING Lots Nos. 4,
5 and 6 in Block 33 as lain down
and described in plat of said town
of Detroit, a copy of which is of
record in Vol. 7, page 417, Deed
Records of Red River County,
Texas.
Plaintiffs allege that on or about
the 1st day of July, 1942, that de-
fendants ejected plaintiffs there-
from and unlawfully withhold the
possession of same from them to
their damage in the sum of $50.00.
Wherefore plaintiff’s pray judg
ment of the Col.i and that de-
fendants be cited to appear and
answer herein that plaintiff’s have
title and p< ssession of said lands
and premises and for such other
relief to which they may be justly
entitled.

proposing an amendment to I
Constitution of the State of Te
by amending Section 33 of Article
16, of the Constitution of Texas
so as to permit the accounting of*
ficers of this State to draw and
pay warrants for salaries to odi-
cers, of the United States Army or
Navy who are as; igned to duties
in State Institutkns of higher ed-
ucation.
BE IT RESOLVED BY THE
LEGISLATURE OF THE
STATE OF TEXAS:
Section 1. That Section 33 of
Article 16, of the Constitution of
the State, of Texas be amended so
as to read as follows:
“Section 33. The accounting
officers of this itate shall neither
draw nor nay a warrant upon the
Treasury in favor of any person,
for salary or compensation as
agent, officer or appointee, who
holds at the same time any other
office or position of honor, trust
or profit, under this State or the
United States, except as prescrib-
ed in this Constitution. Provided,
that this restriction as to the draw*
ing and paying of warrants upon
the Treasury shall not apply to
officers of the National Guard of
Texas, the National Guard R©»
serve, the Officer Reserve Corpe
of the United States, nor to eo*
listed men of the National Guard,
the National Guard Reserve, and
the Organized Reserves of the
United States, nor to retired offi-
cers of the United States An
Navy, and Marine Corps, and t
retired warrant officers and tetir
enlisted men of the United Stai
Army, Navy, and Marine Corpe,
nor to officers of the United States
Army or Navy who are assigned
to duties in State Institutions of
higher education ’*
“Sec. 2. The foregoing Consti-
tutional Amendment shall be sub-
mitted to a vote of the qualified
electors of this State at an elec-
tion to be held throughout the
State on the third day of Novem-
ber, 1942, at which all ballots shall
have printed thereon:
“For the Constitutional Amend*
ment permitting the accounting
officers of this State to draw and
pay warrants for salaries to offi-
cers of the United States Army or
Navy who are assigned to duties
in State Institutions of higher ed-
ucation.”
“Against the C o n s t itutioaal
Amendment permitting the ac-
counting officers of this State to
draw and pay warrants for sala-
ries to officers in the United States
Army or Navy who are assigned
to duties in State Institutions of
higher education.”
Each voter shall scratch out one
of said clauses on the ballots, leav*
1 ing the one expressing his vote on
j the proposed amendment-
Sec. 3. The Governor shall is-
sue the necessary proclamation for
said election, and have same pub-
lished as required by the Cons;
tution and laws of this State, an
the sum of Five Thousand ($5
000.00) Dollars, or so much then,
of as may be r ecessary, is hereby
appropriated from any funds in
the State Treasury, not otherwise
appropriated to defray the i x-
penses of printing said proclama-
tion and of holding said election.
