Owners and Claimants.
THE STATE OF TEXAS TO any
and all persons, firms and corpora-
tions, the names and residences of
whom are unknown, claiming any
title or interest in land under deed
heretofore given to J. C. Rice of
Bexar County, Texas, as grantee,
said deed being from Paul E. Serger
and wife, Clara Serger, to J. C. Rice,
Trustee, dated October 17,1946, duly
recorded in Volume 66 at page 170
of the Deed Records of Kendall
County, Texas; GREETING:
You are commanded to appear
by filing a written answer to the
plaintiff’s petition at or before 10
o’clock A. M. of the first Monday
after the expiration of 42 days from
the date of issuance of this citation,
the same being Monday the 10th
day of November, A. D. 1952, at or
before 10 o’clock A. M. before the
Honorable District Court of Kendall
County for the 38th Judicial Dis-
trict of Texas, at the Court House
in the City of Boerne, Texas.
Said plaintiff’s petition was filed
on the 25th day of September, A. D.
1952.
The file number of said suit be-
ing No. 1341.
The names of the parties in said
suit are: Willie Borroum Rice, a
feme sole, suing therein in her in-
dividual capacity and also in her
capacity as Independent Executrix
of the will of J. C. Rice, deceased,
whose full name was John Chester
Rice, is plaintiff, and any and all
persons, firms and corporations
claiming ownership of or any in-
terest whatever in the land herein-
after described and by virtue of a
deed of conveyance from Paul E.
Serger and wife, Clara Serger, to
J. C. Rice, Trustee, dated' October
17, 1946, duly recorded in Volume
66 at page 170 of the Deed Records
of Kendall County, Texas, are de-
fendants.
The nature of said suit being sub-
stantially as follows, to-wit: This is
a suit in trespass to try title and to
remove cloud and the quieting of
title in plaintiff; plaintiff alleging
that the following described prop-
erty was conveyed by Paul E. Ser-
ger and wife, Clara Serger, to J. C.
Rice, Trustee, by deed dated Octo-
ber 7,1946, duly recorded in Volume
66 at page 170 of the Deed Records
of Kendall County, Texas, to-wit:
All that real estate and property
situated in Kendall County, Texas,
^consisting of two adjoining tracts
known as Outlots Nos. 35 and 36 of
the City of Comfort, and further
described as follows:
FIRST TRACT: That tract known
as Outlot 36, beginning at a stake
set for the eastern comer hereof,
from which a cypress 30 in. dia. brs
N 21 degrees W. 2% varas;
Thence S. 48% degrees W. 500
varas to the southern comer from
which a post oak 7” in dia brs N.
26 degrees E. 13 vs;
Thence N. 41% degrees W. 325
varas to the western corner from
which a black jack 10” dia brs N.
75 degrees E. 6% varas;
Thence N. 63 degrees E. 555 varas
along south boundary of block 37,
a stake set on the bank of Cypress
Creek from which a cypress tree
30” in dia brs N. 17 degrees W. 71
vs and a black walnut 8” dia brs
S. 32 degrees W. 4% vs;
Thence down Cypress Creek with
its meanders to the place of begin-
ning, containing 18-% acres, more
or less, and being the same tract
of land conveyed to Emil Serger by
J. F. C. Vies by deed dated Nov. 24,
1857, and recorded in transcribed
records of Kerr County, in County
Clerk’s office of Kendall County,
Vol. 1 p. 182.
SECOND TRACT: That tract
known as Outlot No. 35, beginning
at a stake set as the east comer of
this outlot, near the south bank of
Cypress Creek from which a cy-
press 8 in. dia. bears N. 64% degrees
E. 26 varas;
Thence N. 33% degrees W. 67%
varas to a cypress 8 in. dia. on said
creek;
Thence up said creek to the north
comer of this outlot from which a
cypress 30” in dia brs N. 21 degrees
W. 2% varas and another 15 in. dia
brs S. 51 degrees E. 9% varas;
Thence South 48% degrees W. 500
varas to the west corner from which
a post oak 14” in dia brs N. 15 de-
grees E. 4 vs;
Thence south 41% degrees E. 330
varas to the south comer hereof
from which a PO 7” dia brs N. 26
degrees E. 13 varas.
Thence North 29 degrees E. 556
varas to the place of beginning,
oontaining 18-3/7 acres of land,
more or less, and being the same
property conveyed by J. F. C. Vies
to Emil Serger by deed dated April
I, 1861, and recorded in Kerr County
deed book B 223, and in Transcrib-
ed records in Kendall County book
1 p. 249.
That the full consideration for
said property was paid by the said
J. C. Rice out of community funds
belonging to j?,im and plaintiff and
that the conveyance of said proper-
ty to J. C. Rice as trustee has cast
a cloud on the title to said property.
That the plaintiff was the fee sim-
ple owner of said property on July
1, 1952, and that on July 2, 1952,
defendants entered upon and dis-
possessed plaintiff of said property
and now withhold from her the
possession thereof.
That the common source of title
to said property is in J. C. Rice.
This suit is brought under and
by virtue of the Acts of the Legis-
lature of Texas, 1931, Chapter 216,
page 369. •
This citation shall be served by
the Sheriff or any Constable of any
county of the State of Texas, by
having the same published in a
newspaper once each week for foui
(4) consecutive weeks, the first
publication to be at least twenty-
eight (28) days before the return
day of this citation, and said officer
shall herein fail not, but make due
return as the law directs.
Issued this the 25th day of Sep-
tember A. D. 1952.
Given under my hand and seal of
said Court, at office in Boerne,
Texas, this the 25th day of Septem-
ber A. D. 1952.

PLANS FOR RANGE
CONSERVATION
FIELD DAY
COMPLETED
Troy Foster, Chairman of the
Range Committee of the Hill
Country Association of Super-
visors, announced that plans
have been completed for the
Range Conservation Field Day
on October 23rd.
Otis Armstrong, who is field
representative of the Texas
Friends of Conservation, has ac-
cepted a part on the noon pro-
gram to discuss the general as-
pects of conservation and the
economic importance to people.
Meris Carter, Area Conserva-
tionist with the Soil Conserva-
tion Service at Uvalde, will dis-
cuss range conservation during
the afternoon tour and several
local ranchers will participate in
this discussion with Carter.
Foster emphasized that every
one should bring their own
lunch since no provisions will be
made by the Committee to feed
the visitors. Tables will be avail-
able on which to spread the
lunch and coffee will be furnish-
ed by the Committee. Cold
drinks will be sold by the Gill-
espie 4-H Club boys.
The range management con-
test and field day will be held
on the Otto Schumann Ranch
near Albert, Texas. Foster stat-
ed that the best way to reach
this ranch is to turn off of the
Fredericksburg—Austin high-
way at the Albert Church, three
miles east of Stonewall. Signs
will be posted on the road to di-
rect visitors from the church to
the ranch.
The grass judging contest will
state at 8:00 a. m. and partici-
pants may enter any time be-
tween 8:00 a. m. and 11:00 a. m.
but all papers must be turned
in by 11:00 a. m.
Four business concerns have
donated prizes totaling $864.00.
These prizes are being offered
to both indivuduals and teams
representing soil conservation
groups. Rules for entering the
contest can be secured from any
of the District Supervisors or
the Soil Conservation Service
office.

Brown. It was a tarpon over
four feet long and was probably
after a trout Mr. Brown was
landing. The Christilles’ were
fishing near by and thought the
men were fighting when the
boat began to rock, then they
saw the fish, so it must be true.

TWO LOCAL MEN
BECOME SHRINERS
Dr. Jack R. Diamond, master
of the Boerne Masonic lodge, a
32nd degree Mason and a Shrin-
er, spent last week in San An-
tonio assisting in the presenta-
tion of Scottish Rite degrees.
Two Boerne men took the
fourth through the 32nd de-
grees: Harold Orcutt and Gor-
don Hollon. Both also became
Shriners.
Dr. and Mrs. Diamond, Mr.
and Mrs. Hollon, and Mr. and
Mrs. Orcutt attended the Shrine
dance in San Antonio Friday.
Mrs. H. S. Martin flew in from
San Francisco, Calif., on Friday
to be at the bed-side of her
father, Wm. Seeger, who is ill
in the Boerne Hospital. She re-
turned to her home on Monday.
