Griffin and Brand
ordered to pay
backwages
A West Texas federal judge
has ruled that owners of a
Presidio County farm did not
absolve themselves from
responsibility for violating
federal wage laws through the
subterfuge of having two of
their employees register as
farm labor contractor.
Judge Lucius D. Bunton
ordered Griffin and Brand of
McAllen, Inc. and Bill J.
Bishop, co-owners of Presidio
Valley Farms, to provide $
85,248 plus nine percent
interest to the U. S. Labor
Department for distrution to
mre than 200 undocumented
farmworkers employed by
them at less than the
prevailing minimum wage
during parts of 1975, 1976, and
1977. The employers paid
documented workers legal
wages for doing similar work
during the same period.
The defendants claimed that
most of the underpaid workers
were not their employees
because they were hired by
crew leaders who were
independent contractors.
However, in a written
opinion, Judge Bunton said the
two alleged contractors,
Eduardo “Lalo” Garcia and
Alfonso “Poncho” Melendez
were not middlemen providing
labor for the defendants but
were, in reality, defendant’s
employees.
Suit was filed by the U. S.
Labor Department on behalf of
the underpaid employees after
department Wage and Hour
compliance officers alleged
that the employer violated the
Fair Labor Standards Act
(FLSA) by failing to pay the
prevailing minimun wage and
by falsifying pay records.
Although the defendants
were apparently complying
with’the act at the time of the
trial, Judge Bunton enjoined
them from further violations of
the FLSA “due to the
willfullnes of Defendants
violations fo the F.L.S.A., the
prior litigation between the
Secretary of Labor and (Griffin
and Brand) and Defendants’
conscious attempt to avoid
paying the minimum wage...”
Consequently, further viola-
tions of the FLSA could
constitute contempt of court.
The Labor Department
expects to request help from
the Mexican government in
locating the underpaid work-
ers, most of whom lived in
Ojinaga, Chihuahua, Mexico.
Money due former emplo-
yees who cannot be located
will be deposited in the U. S.
Treasury.
