37, AKTICLE 37 1. AND ARTI-
CLE 37-2, OF THE CITY CODE
OF SMITHVILLE I EXAS, REG-
ULATING THE STORAGE AND
HANDLING OF GASOLINE
AND OTHER VOLATILE IN-
FLAMMABLE OIL AT ANY RE-
TAIL F. S T ABLISH MENTS
WITHIN SAID CITY OF SMITH-
VILLE. BASTROP COUNTY,
TEXAS, AND PROVIDING A
PENALTY FOR VIOLATIONS
OF THIS ORDINANCE. AND
DECLARING AN EMERGENCY:
BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY
OF SMITHVILLE. TEXAS:
That Title XIV, Chapter 37,
Article 37-1 and Article 37-2. of
the City Code ol' Smithville,
Texas, as pa: 1 and approved by
the City fours'll of the City of
Smithville, Texas, regulating the
storing and handling of gasoline
and other volatile inflammable
oil at retail i tablishments within
the corporate limits of the City of
Smithville. Texas, and providing
penalties for v lations thereof, is
hereby amend'd, and shall from
hereafter n ad as follows:
Art. 37-1 No person, firm, as-
sociation or corporation shall keep
or store within the corporate
limits of t!’• City of Smithville,
Texas, ga or other volatile
inflammable nil in, or under pre-
mises used as retail establish-
ments, in a t> Hal amount greater
than 4,950 gallons; or in more
than four storage tanks having a
capacity of 1 re than 1100 gallons
each, plus nc 550 gallon under-
ground v ■ st. oil storage tank.
Art. 37-2: No person, firm, as-
sociation or corporation shall un-
load gasoline or other volatile in-
flammable oil at any retail cs-
tablishrnent within the corporate
limits of the City < f Smithville,
Texa from a tank truck, or other
container, that has combined
capacity in excess of 1500 gallons.
Art 37-3: The provision: of the
foregoing section shall not apply
to zny person .....
or corporation transporting gaso-
line or other volatile inflammable
nil within or tin ngh the corpor-
ate limits of th City of Smith-
ville, Texas, in the normal course
of business and not for the pur-
pose of unloading the same at a
retail establishment within such
corporate limits,
Art. 37-4: Any person, firm, as-
sociation or corporation who shall
violate any of the provisions of
this ordinance shall be deemed
guilty of a mi k ameanor, and,
upon conviction, hall be fined
not more than One Hundred
($190.00) Dollars, and each day
such violation continues shall con-
stitute a separate offense.
Art. 37-5: All ordinances, or
parts of ordinances, in conflict
herewith are repealed to the ex-
tent of such conflict.
Art. 37-6: If any provision of
this ordinance or the application
thereof to any individual person,
firm or corporation shall bo held
to be invalid, the remainder of
this ordinance anil the application
of such provision to other indivi-
duals, persons, firms or corpora-
tions shall not be affected there-
by.
Art. 37-7: The fact that owners
of retail places patronized and
frequented by the general public
are preparing to unload and store
gasoline in large quantities at
such retail places, causes a fire
hazard dangerou: to the public,
creates an emergency and an im-
perative public necessity that this
ordinance will take effect imme-
diately upon its passagi. approval
and publication as required by
law.
I, Alderman Hugh C. Cole,
move that the above ordinance
be approved and adopted, and
that the Mayor and the City
Secretary be authorized to sign,
attest and publish same, as re-
quired by law.

City Alderman
We would like to give you a
brief analysis of the past history
of a man we hope to elect as city
alderman on April 7, of this year.
Mr. Carl B. Rowe was born and
reared on a farm in Cado County,
Oklahoma, of which he still owns
an interest. After his school years
he worked as an automobile
mechanic and shop foreman, later
operating an automobile general
repair shop of his own for a per-
iod of seven years. Selling his
business in 1937 to accept a posi-
tion with the Texas-New Mexico
Pipe Line Co., as machinist, he
later transferred to the rating of
Diesel Engineer, which he still
holds.
Mr. Rowe was transferred to
the Rosanky pump station in
1939, where he lived in a com-
pany house until 1948—at that
time he bought a home and mov-
ed to town, where he has lived
for the past five years.
While living in the Rosanky
community, he sent his daughter,
Nancy Ann to Smithville to school
paying her tuition and bus fare
out of his own pocket, until she
entered high school. While serv-
ing as school trustee, he convinced
the people that it was a MUST
to abolish the Rosanky school,
buy a new bus, and transfer to
the Smithville schools.
Being a successful leader, he
served as chairman each year for
the Red Cross, March of Dimes,
and Community Chest Fund, and
has served as local chairman of
the Oil Workers International
Union ever since it organized in
1946. He played a major role in
securing the farm to market road
from Rosanky to Smithville, hav-
ing organized a group of com-
munity men and met with the
Commissioners Court in Bastrop
to see why the necessary right of
way had not been obtained; the
Judge gave the committee the
authority to go ahead and secure
the right of way.
Now you good people of Smith-
ville, where would you go to find
a man more qualified with past
experience to serve you? He is a
member of the local Presbyterian
Church, Scottish Rite, Masonic
Lodge, Independent Order of Odd
Fellows, Rebekah Assembly, and
the Chamber of Commerce.

state, was being cross-examined
by a bullying counsel.
"Do you mean to tell me you
have always treated your wife
with respect?" asked the counsel.
"Always,” replied Henpeck

"And you’ve never once spoken
a hasty word to her?”
Henpeck hesitated for a mo-
ment and the lawyer was quick
to seize the opportunity. He
roared, "I want the truth!
“Well," faltered Henpeck at
last ,‘I remember I did say to her
once, 'Put down that poker’!”
