west of the city A passer by found
four wot shivering children huddled to-
gether who had spent the previous night
iu the woods thinly clad without shelter
or coverings This morning they found
the schoolhouse and crept into it Tho
two eldest were girls fourteen nnd ten
years ol Tho other two boys eight
and six years old They gave the name
of Thompson The girls are named
Emma and Kate Their mother lived in
Bed Biver county was severely burned

poor farm and these children had
started afoot to find some relatives liv-
ing in Fannin county They had walked
all day yesterday and laid all last nisht

been steadily pouring down here They

owing to tho absence of Mayor Connor In
Memphis
It will be remembered that at the la9t
council meeting Alderman Webster tri d
to present a petition to tho body and was
ruled out by the chnir aud by a vote of
IS to 2 the chair was sustained Last
night the petition was ngniu presented
aud ruled out by tho mayor pro tem
Argument followed nnd an appeal was
taken from tho ruling of the chair with
tho following vote yens 8 nays 9
The petition rends ns follows
I desire to call your attention nnd n k
favorable consideration thereof to what
I consider a seriously objectionable fea-
ture that has generally prevailed hereto
fora la the manner of drawing contracts
for public work in this city The feature
I havo reference to is the lodgement In
tlie hands of the supervising engineer
on tho part of the city of what I think is
altogether too great a latitude for the
exercise of his independent discretion to
modify the terms of such contracts For
example In the waterworks contract
which has recently occupied so much of
your time It is specially provided that
the supTvising engineer shall havo the
authority at his will to change or
modify the demnnds for tho work as
called for m the specifications and
further that upon uny disagreement
nrlsing between the city and the con-
tractors such engineer shall be the
nrbiter of tho matter iu dispute from
whose decision there shall bo ullowod no
appeal
Like Iatitudinous powers aro I under-
stand engrafted on all streetpaving
contracts heretofore lot by the city and
doubtless will be found in other contracts
of liko importance Now I havo no in-
clination to 6117 that the supervising en-
gineer in the waterworks contract is
other than a capable und bouest gentle
manor that the gentlotnen iuvested with
the power alluded to in other coutraots
ore not honorable and intelligent men
jot I can but think that the great au-
thority vested In them is lodged lu the
wrong place It seems to me that when
a contract for a public work is let and
certain plans and specifications are
agreed upon to govern the work and arc
incorporated iu the contract It is these
same plans and specihcutions which
should govern and oontrol the perform-
ance of the work nud that they stiuuld
not bo subject to every change modifi-
cation aud diminution which the interest
or individual whim of a super-
vising engineer however honest
and cnpnble he may be shall see proper to
sanction Plans and specifications wbon
embodied in a contract for work surely
mean something nnd nre put there for a
purpose What u farce theu does it be-
come when the same Instrument which
demunds the performance of a work iu
uccordnuco with certain specifications
and plans deliberately nullifies and ren-
ders valueless the stipulations by follow-
ing it up with a clauso which virtually
permits a supervislug engineer to add to
dimmish or chango thorn when ho may
see proper
1 wish therefore to place myself oa
record as condemning the contracts here-
tofore eutered into whero suoh latitude
has been allowed the supervising en-
gineer as unwise and unfair to the city
and further to enter my protest against
such features being incorporated In any
contract hereafter let Such contracts
should In my opinion demand that the
work be done strictly In accordance with
the plans aud specifications agreed upon
aud embodiei in the contract uuiess
changed thereafter by mutual agreement
of council and contractors and the solo
charge of the engineer should be to seo
tbat the city gets exactly what Is called
for by ius contract and in case any dis-
agreements arise as to faithful perform
ance of the work final arbitrament
should be left where it properly belongs
