LAWYERS ASD LABORERS
A Io1cr1 Discussion ot the llelntlon ot tho
Lawyer to Oilier Classes of Intior
FOItT WOHTHfffEX Oct 11180
To the Kdltor ot tho Rism
la tho discussion ofpolltlcal questions
upon the hustings and elsewhere we hear
frequent charges made ngilnst lawyers
as to the part they play In trio creation
and furtherance of govcrmental schemes j
and among those charges are the follow
iDg specifications vlii
1 That lawyers are till tho tools and
agents of monopoly In somo form or
auothor
2 That lawyers aroln opposition to the
rights of tho laboring and Industrial
classes and to any system ot legislation
for the protection thereof
3 That lawyers are morally and polltl
colly unworthy of trust In positions ot a
public nature
4 That lawyers aro chronically In
cllned to seek said positions and have to
a great extent monopolized them
0 That lawyers by trickery rnanlpu
Wts conventions in tho Interest of their
friends and themselves
I alllrm that theso charges are false in
theory and In fact even to tho slightest
shado thereof and that reason and expe-
rience prove them to bo so while on tno
other hand I afllrm to wit
1 That lawyers are not the tools nor
agents of monopoly and that they are
both in the theory and practice of their
lives opposed to tho exercise ot special
powers and privileges by Incorporated
capital tn such a manner as to Interfere
with the rights of thu laboring and In-
dustrial class orany other of tholr fellow
countrymen
2 That lawyers aro In favor oi legisla-
tion looking tu tho protection ot labor-
ers handicraftsmen and every other class
of American citizens who are bolng
wronged by monopoly lu vlrtuo of Its
special powers granted by the govern-
ment and while they would not
cripple capital they are most
truly and assuredly opposed to capital
crippling labor and while they would not
cripple labor they would ask labor not to
ctlpple capital by an tlntcrforcnco with
tho rights of property but to seek
rather to inaugurate legislation among a
sovereign people for the prevention by
legislation of monopolistic oppression
3 That lawyers have proven as a
class to bo more faithful in positions of
public trust than any other and that
loglslationjcmanatlng from them has been
of tbo greatest benefit to mankind
i That they are moro sought after for
positions ot trust than they seek tho same
from the fact that thoy are constantly ob-
serving tho effects of law upon tho com
monwealth und aro thereby rendered
efllclcnt in expunging Incipient causes
from law which may bo detrimental to
the interest of the peoplo and by their
habits of terseness in expression give
certainty to statutes emanating lrom
them and that they lmvo been sought by
the people until these samo peoplo now
call them a quasi political profession
5 That In convention lawyers simply
cxciclso the privilege of tree American
citizens and as they take an Interest In
their country they always attend them
which tho grumbler never does and that
lawyers being fow tho people could keep
them out of conventions if they desired to
do so
1 In what respect are lawyers tools ot
monopoly or the agents thereof An
agent either general or special is
the hired servant ot his prln
cipal The servant ot a mas tor
for other things thandefense will nntu
rally defend the roaster In other things
outside his special service The agent Is
Inclined as a natural rule to defend the
general character and rights of his prlnci
pal although said defense does not fall
within the line of his employment With
out friction then between principal and
agent this Is unquestionably the general
rulo 01 course then tho rule becomes
Intensified when tho act ot employment is
for nothing clso but to dbfend in thu
courts of justice tho rights ot tho prlnci
pal Are not lawyers then moro tho
agents of those whose Interests are
jeopardizedand whose rights are violated
by monopolistic and incorporated powers
than they aro the tools ot theso powers
sinco lawyers for the most part represent
tbo laboring and Industrial classes In tho
courts as against aggregated wealth Thus
they btcome both by employment and by
habit in sympathy with tbolr clients to
wit the laboring and industrial classes
Go to the dockets ot our courts and see
how many lawyers out of cghtyfle In
Fort Worth are tho hired attorneys of
corporations Not moro than ten at the
least and all ot these represent a vast
number of clients from among tho com
mon people Lawyers learu to love thu
science of law and would seo all evils In
government corrected by law Their life
their labor tbelr profession lead them to
desire a legal government with tho laws
thereof growing out of tbo people not
out ot a monarch at least in this coun-
try nor yet out of tho uncontrolled do
Sires and passions of anarchy They
would see all men have tho liberty to do
right but would bee no man havu the
liberty to do wrong Laws to secure
protection to tho life liberty
and property Is the ultimate end
ot nil govcinments Itight princi
ples aro embodied In these laws
and said laws accumulated from ages of
wise and just decisions ot good men are
constantly before tho lawyer and develop
tn him the disposition to relegate all
queStlons of difference between man and
man to the halls of legislation and tho
courts of justice And he therefore be-
comes a pacific and prudent man In olllco
The absence ot law Is not liberty for the
Idea of liberty Involves tho Idea of law
and this absence of law is nothing but
anarchy socialism contusion where
every individual flies off at a tangent and
becomes a government tor himself and
unto himself alone and peope who would
thus enjoy every absolute or natural de-
sire become dissatisfied eveu when
enjoying tbo prodigality of a gener-
ous republican government because they
disregard the relative bearings of the
course they would pursue Lawyers
therefore would only have their friends
seek redress In law and will therefore
always condemn any disregard of law
Not that they are In sympathy with those
whom some unjust commission or omis-
sion of legislative duty may favor but
thatthey would uphold the majesty ot
tho state The lawyers of Greece wcro
her best defonders and tho voice ot
Demosthenes rang out for tho people
Cicero defended the ploulanB against
patrician arrogance Knglish lawyera
stood up In tno Dritlsh parliament In bo
halt ot the people against tbo assumptions
of Charles II and denied to him tbo
divine rights of ruling the kingdom alone
Prom lawyers in the main came tbo
groat magna charter and the other bul
works of civil liberty that dually over-
throw absolute despotism In England
and set the example to the rest of the
civilized world Old Samuel Adam
ratrlck Henry Jefferson Webster and
hundreds ot others woro defenders ot
the people They wcro lawyers and they
have worthy sons ot this age who can
well stand tho slanderous atticks ot do
craded and lying demagogues and tbo
foolish hatrod ot cross road polltltlous
who havo moro ambition than tboy havo
brains and are disgruntled be
cause thoy think they might arcln
dlo tho people It tho lawyers
would stay out ot politics and not expose
tho fraud But while lawyers havo al
ways been thu friends of the pipple against
oppression and centralization they aro >
also opposed to Uio despotism that grows
out ot anarchy So tho Infamous asser-
tion and slander that lawyers aro In any
wlvo the tools of monopoly Is a rcductlo
ad absurdum
2 What Is thero to Indicate that law-
yers are In opposition to tho Interests ot
tho laboring and Industrial classes
Whore have thoy showed it His on Im-
possibility to point to an Instance in his-
tory where thoy have as a class mule
war cither directly or Indirect-
ly upon tho Interests of
wagoworkors But I am told that they
show It when they arcclcctcd to congress
and to tho legislatures When How
And where Tako a lawyer who Is n
congressman You say ho has bcon un
faithful at least you havo been told so
But how do you know ho Is not slan-
dered Admit however ho Is a defaulter
to duty Where do most ot your de-
faulters come from About onesixth of
tho defaulters In tho state and federal
government coma from thu lawyers In
proportion too to tho number holding
olllco that Is about llvo to ono of every
other class in ofllco aro treacherous to
tholr constituency to whero thcru Is one
lawyer Your stato treasurers aud your
crcdltmoblllers and backsalary grab-
bing to a great extent lucked tho legal
element If any man will take pains to
examine minutely Into defalcations which
havo occurred both In stato aud national
governments and Into tbo actions ot
those who havo controlled and legislated
upon the rights ot tho peoplo ho will Had
thero has been moro lost to tho peoplo
thwugh tho rascality and treachery ot
every other class represented In legisla-
tive assemblies in this govornment than
by lawyers Balancing tho good aud evil
dono by all alike tho problem when
solved will result as I havo said It Is
simply stuff and nonsenso to say that
lawyers aro enemies to tho class who
nlo them their business and hence their
living and tho assertion Is oniy uttorcd
by lying demagogues and their cohorts
and Its assertion Is lntcnsoly disgractul
when coming from a man claiming to bo a
lawyer I hope no man In Tarrant county
has become a legal mlulmus But labor
organs seem to approvo Beck and Coke
and llcagan and these men are lawyers
And even If somo lawyors In congress
have loaned themsehes to monopoly
Is that any reason why thu whole
protcssion should be charged with being
tbo tools and minions ot monopoly to
crush tho farmer andgwageworker when
the profession depends upon that class
tor Its sustenance It would be simply a
social or political paradox that is without
parallel
8 Bat lawyers aro said to bo morally
worso than others that It will nevur do
to trust them that thoy will prove treach
erous and unfaithful In public positions
andthat thoy ro traditional liais Now
lawyers by sllcnco by jest by pandering
aud truckling to others have aided In
disseminating and perpetuating these
slanders lt is tlmofor them to call a halt
and assert tholr rights There are many
fools who bollcvc these slanders and
some who are not tools like to toll these
things for the truth Thu lawyer is geulal
and laughs at slandor He Is said
to be a moral nuisance and a necessary
evil yet all come to him Ills oar is tho
rccoptlcal ot moro secrets than thu con
fesslonal The frailty and lnllrinlty of
human nature are laid bare before him
and he must study and contend and
light at the bar of justico for those who
havo been wronged Tho murderer tho
robber the thief the rapist injured
wives disgruntled husbands all all come
to him and entrust to his care and con
fidence the nearest and dearest Interests
ot life and then turn and say ho is un-
worthy of trust and those who law
most are those who now abuse tho law-
yers Tho church opens her doors to
lawyers so does society yot they are
classed with gamblers ana saloon
keepers It Is not only tho privilege but
the duty of a lawyer to tUfend his pro-
fession when as a candidate his
profession Is mado a ground of
objection to bis holding olllco
Lawyers aro not better than somo men
perhaps but they are better than some
and surely he has reason to fix his moral
standard high when ho has grand pre-
cepts on the ono hand and sees too much
rascality on tho other
4 Peoplo havo sought lawyers for
ofllclal positions This does not need
argument for there Is not a voting
place or precinct In the United States
where he could obtain anything except
tbo peoplo gavo it to him and even if ha
did seek what could he avail unless he
woro sought
C The same reason will hold good in
conventions How could he cvor get to
a convention unless tho people send him
And thero Is not a precinct in Texas
where the laboring and Industrial classes
are not in the majority How could the
lawyer control these except by outvoting
tho whole crowd This defenso is not
needed The lawyer can rest In Inde-
pendence slnco tle frailty of man In-
sures his livelihood Ho can keep silent
becauso conscious of bis own worth and
tho futility ot all such assertions as aro
herein considered but thoy baTO rights
and havo pandered them away to satisfy
the people who sometimes become
blinded for a while by wlaomouthed
blatant demagogues who would stand by
a murderer like Pontius 1ilato stood by
Christ and say we saw no evil in him
