Area physicians among
state medical board
disciplinary actions
Some area doctors were among those
upon which action was taken during
the Dec. 3-4 meeting of the Texas Medi-
cal Board. During the same meeting the
board adopted some rule changes.
The Texas Medical Board disciplined
54 licensed physicians and issued two
cease and desist orders. The disciplin-
ary actions related to quality of care,
unprofessional conduct, revocations,
voluntary surrenders, suspensions, im-
pairment, advertising violations, inad-
equate medical records and more.
The board issued 137 physician li-
censes at the December meeting, bring-
ing the total number of physician li-
censes issued in the fiscal year 2016 to
800.
Among those upon whom disciplin-
ary actions taken were:
QUALITY OF CARE
Shaun Bobbie Kelehan, M.D., Mar-
shall
The board and Kelehan entered into
an Agreed Order requiring him to have
his practice monitored by another phy-
sician for eight consecutive monitor-
ing cycles; within one year and three
attempts to pass the Medical Jurispru-
dence Exam; within one year complete
at least 20 hours of CME. The board
found Kelehan failed to provide ad-
equate oversight of a patient's prog-
ress and diabetic condition who was
participating in an insulin clinical trial.
Although the patient was counseled to
communicate any medical problems
experienced, Kelehan should have also
counseled the patient to communicate
low blood sugar levels, regardless of
whether the patient experienced relat-
ed symptoms. The doctor admitted that
at the time of the patient's death, he
was not enrolled in the Texas Electronic
Death Registry system as required, and
therefore did not utilize the system to
file and/or certify the patient's death
certificate.
UNPROFESSIONAL CONDUCT
James R. Motlagh, M.D., Tyler
The board and Motlagh entered into
an Agreed Order requiring him to with-
in one year and three attempts pass the
Medical Jurisprudence Exam; within
one year complete at least 24 hours of
CME of eight hours in risk manage-
ment, to include HIPAA, eight hours in
patient communication and eight hours
in ethics; and within 60 days pay an
administrative penalty of $1,000. The
board found Motlagh breached doctor/
patient confidentiality with one patient
by taking photographs and video of the
patient during a procedure and subse-
quently posting them on social media
without consent.
REVOCATION
Joseph M. Megwa, M.D., Arlington
The board entered a Final Order
against Megwa, M.D., which revoked
his Texas medical license. The board
learned he was found guilty of the fel-
ony offenses of one count of conspira-
cy to commit healthcare fraud, three
counts of healthcare fraud, and four
counts of false statements relating to
healthcare matters. He was sentenced
to 120 months in prison which began
on Jan. 22, 2015.
Don Martin O'Neal, M.D., Sulphur
Springs
The board entered a Final Order
against O'Neal, which revoked his
Texas medical license after finding he
entered a guilty plea to the criminal
charge of theft of property, an enhanced
state jail felony and was placed on com-
munity supervision for eight years,
and ordered to pay the Health and Hu-
man Services Commission $42,048.25,
imposing a $5,000 fine, and directing
O'Neal to pay court costs of $531. The
action was based on the findings of an
administrative law judge at the State
Office of Administrative Hearings.
O'Neal had 20 days from the service of
the order to file a motion for rehearing.
VOLUNTARY SURRENDER
Barbara Morgan Pinson, M.D., Quit-
man
The board and Pinson entered into
an Agreed Voluntary Surrender Order
of her Texas medical license in lieu of
further disciplinary proceedings. The
board received information that Pinson
is unable to practice medicine with rea-
sonable skill and safety to patients be-
cause of illness or as a result of a mental
or physical condition and that she has
not practiced medicine since August
2014.
CEASE AND DESIST
Amalia Figueroa, Arlington
The board and Figueroa entered into
an Agreed Cease and Desist Order, pro-
hibiting her from acting as, or holding
herself out to be, a licensed physician
in Texas. The board found Figueroa ad-
mitted to the Texas Alcohol and Bever-
age Commission officers during an in-
spection of El 8 Sports Bar in Arlington
that she treats patients in a back room.
Steven Blake McDonald, Flower
Mound
The board and McDonald entered
into an Agreed Cease and Desist Or-
der, prohibiting him from acting as, or
holding himself out to be, a licensed
physician in Texas. The board found
he asserted that he was a surgeon re-
sponding to an emergency call during a
traffic stop by a Fewisville police officer
and later admitted to a judge during the
plea hearing that he was not a licensed
physician in Texas nor a graduate from
a medical school.
RULE CHANGES ADOPTED
Amendments relating to Medical
Records Regarding an Abortion on an
Unemancipated Minor were adopted
in accordance with House Bill 3994,
enacted by the 84th Fegislature. The
amendment changes language so that
a physician who performs an abortion
on an unemancipated minor during a
medical emergency is required to exe-
cute an affidavit explaining the specific
nature of the medical emergency that
necessitated the immediate abortion
and include a copy of the affidavit in
the minor patient's file.
Further, a physician is required to
maintain in the minor's medical record
a return receipt of a required written
notice from the physician who per-
formed an abortion on the minor under
emergency circumstances without the
opportunity to obtain consent, to the
parents or guardians of the minor. The
amendments also require that if the no-
tice was "undeliverable," the physician
must maintain a copy of the notice it-
self.
Military doctors
Another amendment provides mili-
tary service members who hold a li-
cense to practice in Texas two years of
additional time to complete any other
requirement related to the renewal of
the military service member's license.

This damage to the driveway to City Cemetery off Belcher Street was noticed last week. There is another
way to get in the cemetery, from the back of Cedars Memorial Cemetery.The previous Sunday Mineolans

Correction
It was pointed out

owned the chiropractic
office on Highway 37
that burned early in the
year. It should have said
Dr. Jason Fowler owned
the property. Franklin
had sold the property to
Fowler years before the
