hereof, in some newspaper publish-
ed in your County, if there be a
newspaper pumished therein, but
it not, then in the nearest County
where a newspaper is published, to
appear at the regular term of the
District Court of Delta County
to be holden at the Court Hon-’
thereof, jn Cooper, on the first
Monday in October, (A. D, 19D7
the same being the 4th day of
(October, A. D. 1937, then and
there to answer a pleading filed
in said Court on the 5th day cf
April, A. D. 1937. in a suit, num-
bered on the docket of said Court
No. 3849 wherein Jasper W. Clark,
and wife, Ruby Clark, are Plain-
tiffs, Sulpur Springs State Bank,
of Sulphur Springs, Texas, a cor-
poration, is defendant (Garnishee)
a brief statement of plaintiff’s
cause of action, being as follows:
Plaintiffs, by petition filled in this
court on the 22nd day of February,
A. D. 1937, applied for a writ of
garnishment against Sulphur
Springs State Bank, of Sulphur
Springs, Texas, alleging that said
Bank was indebted to or had in
its hands effects belonging to B.
I. Daniels, Mrs. B. I. Daniels, R.
R. Daniels, Mrs. R. R. Daniels, and
K H. Badgett, and D and G Drill-
ing Company, Plaintiff claiming
an indebtedness against the said
B. I. Daniels, Mrs. B. I. Daniels, R.
R. Daniels, Mrs. R. R. Daniels
and A. H. Badgett, and D and G
Drilling Company, of $671.7(5
Whereas said Garnishee by sworn
written answer filed in said suit
on the 5th day of April, 1937, al-
leged that it held in its hands, a
sum of $1750.00 deposited with it
in the name of F. J. Estes, and
I A.. H. Badgett, and that it did not
know what part thereof belonged
to the said A. H. Badgett, and
what part thereof belong to the
said F. J. Estes, and asking that,
the said F. J. Estes adjudicated;
Wherefore, Plaintiff prays that
the said F. J. Estes be made a
party to this suit and that upon
final hearing hereof. Plaintiff
have judgment of the court as
prayed for.
Herein Fail Not but have be-
fore said Court at its next regular
term, thu writ with your retu
thereon, showing how you have
executed the same.
