SDear Mr. Curtis:
A federal civil rights suit has been filed in the Northern
R District of Texas challenging the constitutionality of Article 21.06
of the Texas Penal Code. The Plaintiff has moved the court to
certify a class of defendants consisting of all district, county and
city attorneys of the State of Texas. If the court certifies the
I defendant class, it probably would not notify the class members, and
there probably would not be an opportunity for defendant class
members to "opt out" and be separately represented. If you are
interested in intervenin in this suit, sugest that you do so
R well in advance of the class certification hearing on September 15.
19 ., If I do not receive a response from you before September 1, I
will assume that you have no objection to the certification of the
class and I will respond to the class certification motion on that
assumption.
5 A copy of the plaintiff's complaint is enclosed.
