The Dallas County Sheriff's Department on
Monday placed a bailiff on a 10-day, unpaid
suspension for making derogatory remarks
about a rape victim who is a lesbian.
The bailiff, Robert Earl Smith, admitted to
sheriff's investigators that he had made the
remarks to a defense attorney during the rape
trial. Several people, including the woman's
friend, overheard him.
"If it was me (on the jury), I'd only give
him 30 days for raping a lesbian," witnesses
quoted Mr. Smith as saying. They also said he
had made lewd remarks about lesbians' anato-
my.
Sheriff Jim Bowles said he would "not con-
done such behavior."
On Monday morning, a Sheriff's Depart-
ment panel decided the punishment after
hearing results of an internal affairs investi-students, driver
' '~t L yaJ"~ . t#: iU anation. It ruled that Mr. Smith had violated
department policy, including rules that pro-
hibit using "indecent, profane or harsh lan-
guage," deriding or humiliating any person,
and engaging in "unnecessary conversation
in a public place."
Mr. Smith has written a letter to the woman
who was raped, apologizing for his comments,
the sheriff said.
Later Monday, about 30 demonstrators
gathered in front of the Frank Crowley Courts
Building to express their disgust for the bai-
liff's comments. They carried placards read-
ing, "Hey Bailiff Smith, men can be raped, too.
Apologize now," and "Stop courtroom abuse."
One of the protest organizers, lawyer Adel-
fa Callejo, said all residents of Dallas County
should be concerned.
"This is not only a gay and lesbian issue,"
she said. "It is unthinkable and immoral that
