Smith’s
capital
murder
trial
delayed
BY BEN TINSLEY
ben.tinsley@baytownsun.com
ANAHUAC - A judge on
Wednesday postponed the
pending capital murder trial
of Kevin Edison Smith until
April. The defendant is
accused of raping and mur-
dering a 13-year-old girl in
March 1996.
The case has been delayed
because Smith’s defense
attorney, Stephen
Christopher Taylor, has a
separate death penalty capital
murder case scheduled for
Jan. 23 in Lufkin.
Chambers County District
Attorney Cheryl Lieck could
not immediately be reached
Wednesday to elaborate on
the postponement.
The 46-year-old defendant
was not brought into the
courtroom from jail for the
Wednesday rescheduling.
Smith’s antics and disrup-
tive public behavior during
public appearances in court
have extremely agitated offi-
cials.
In November, Smith
became extremely upset
when he noticed news cam-
eras in the hallways. He
blurted out loud exclama-

Bayou-area
residents
not taking
noise quietly
BY MARK FLEMING
mark.fleming@baytownsun.com
The first meeting of the year for Friends of
Cedar Bayou United focused largely on the con-
tinuing issue of noise from a pipe and tube facil-
ity operated by TMK 1PSCO across Cedar
Bayou. The sound of pipes clanging against one
another was audible outside the Roseland Park
Pavilion while the group was meeting Tuesday
night.
The group, which primarily works with con-
servation efforts on the bayou, has recently
taken on the effort of getting something done
about noise from the plant. Many of the group’s
members live in the neighborhoods along the.
bayou.
During the meeting, group members discussed
strategy to keep pressure on city officials to deal
with the noise issue. Council member David
McCartney, whose district includes the affected
area, told residents their complaints were being
heard and acted on. He also said that, while his
home is further from the bayou than some, he
can often hear noise from the pipeyard in his
home.
Residents from FCBU have met with City
Manager Bob Leiper and other city officials
about the issue, and have also, met with plant
management and toured the pipeyard facility.
When they met with pipeyard management,
managers agreed to some changes to reduce
noise - group members said changes discussed
included adding irjsulation to a processing build-
ing, reducing the/slope of tracks that pipes roll
on, opening bundles of pipes on wooden pallets
