nels county:—
Now comes R. K. Wylie, Mollie Mo-
denia Wylie and Cicero Smith, who are
hereinafter styled plaintiffs, and all of
whom reside in Palo Pinto county Tex-
as, and complaining of Johann Mein-
ecke, and the unknown heirs of Johann
Meinecke deceased, who are hereinaf-
ter styled defendants, and whose places
of residence are to these plaintiffs un-
known. And for cause of action here-
in plaintiffs represent and show to the
court: That on or about the first day
of January A. D. 1907 these plaintiffs
were lawfully seized and possessed of
the following described tract or parcel
of land lying and being situated in the
county of Runnels and state of Texas,
holding and claiming the same in fee
simple, towit: Six hundred and forty
acres of land known as Survey No. 411,
abstract No. 380, located by virtue of
certificate No. 309 issued to Johann
Meinecke, and patented to said Johann
Meinecke by patent No. 732, Vol. 13
dated Dec. 1st. 1856. Said 640 acres
being described by metes and bounds as
follows, towit: —
Beginning at a stake set for the lower
corner of Survey No. 410 on the South
Bank of the Colorado Rivyr from which
a willow 15 inches in diameter bears
N. 26. E. 8 varas, anode • willow 9
inches in diameter bears N. 68. 10 varas.
'1 hence S. 30 W. 4285 vara to a stake
and mound. Thence S. 60 E. 950 varas
to a stake and mound. Thence N. 30.
E. 3315 varas to a stake on the Bank
of the river from which a* mesquite 6
inches in diameter bears S. 45. E. 18
varas, another mesquite 12 inches in
diameter bears S. 67 E. 19 varas.
Thence up the river with meanderings
to place of beginning. And that upon
the day and year last aforesaid the
aforesaid defendants entered upon said
premises, land and tenements and un-
lawfully ejected these plaintiffs there-
from, and now unlawfully with-holds
them from the possession thereof to
their damage in the sum of $5000.00
That plaintiffs, claiming to be the
true and lawful owners of the above
described tract and parcel of land,
have had and held under title and color
of title from and under the State of
Texas, peaceable, continuous and ad-
verse possession thereof for a period
of more than three years next preced-
ing the filing of this suit and the said
1st. day of January A. D. 1907. which
they are ready and willing to verify,
etc.
That these plaintiffs and those under
whom they claim, and whose estate
they have, claiming the same under
deeds duly registered iu Runnels coun-
ty, Texas, have had and held peaceable,
continuous and adverse possession of
the above described land, premises and
tenements, cultivating, using and en-
joying the same for a period of more
than five years next preceding the fil-
ing of this suit and the first day of Jan-
uary A. D. 1907, and paying all taxes
due thereon during said five years,
which they are ready and willing to
verify etc.
That these plaintiffs and those under
whom they claim, and whose estate
they have, claiming to have good and
perfect right and title to the above de-
scribed land and premises, h *.ve had
and held the same peaceably, continu-
ous and adversely to all the world cul-
tivating, using and enjoying the same
for a period of more than ten years
next proceding the filing of this suit
and to the said 1st. day of January A.
D. 1907, which they are ready and will-
ing to verify, etc.
Wherefore plaintiffs pray judgement
of this court, that the said defendants
be cited to appear and answer this pe-
tition, and that upon final hearing here-
of that these plaintiffs have judgement
for the title and possesion of the said
above describe land and premises, that
writ of restitution issue, and for their
damages and all cost of suit, and such
other nnd further relief, general and
special, in law and equity, as they may

Eighty acres of land, on the water of
the Colorado River about 26 miles N.
76 W. of the Junction of the Colorado
and the Concho Rivers, known as sur-
vey No. 93 1-2, Abstract No. 244 locat-
ed by virtue of Hen iright certificate reside in Palo Pinto county, Texas, and
No. 105 issued to the estate of said who are hereinafter stylet! plaintiffs,
Samuel Herring, and patented to the complaining of Samuel Blair, and the
< heir of said Samuel Herring on the
27th day of January A. D. 1875 by pat-
ent No. 8. Bounded as follows, towit;—
Beginning at the N. W. Comer of T. &
N. O. R. R. Co., survey No. 93.—
Thence North 3800 varas to a stake in
the prnirie for the N. W. comer of this
survey Thence East 1900 varas to a
'stake .or the N, E. comer of this sur-
sroy.

end now unlawfully with-holds from

damage in the sum of $5000.00.
The plaintiffs; claiming to be the
true and lawful owners and holders of
the above and foregoing described
tract of land, have had and held under
title and color of title from and under
the State of Texas, peaceable, con-
tinous and adverae possession thereof
for a period of more than three years
next p’eceding the filing of this suit
of said Court, at office in Ballinger this
