A district court has ruled an
appeal to save convicted
Baytown killer Robert Acuna
from the death penalty a moot
issue now that Gov. Rick Perry
has commuted his sentence to
life in prison.
Acuna’s appeals lawyer,
Allen Ishbell, said he filed the
motion in protest of the death
sentence the day before Perry’s

“No one likes to learn that
there are fines on their
library record,” said library
director Katherine Brown.
Acuna was 17 and a student
at Sterling High School when
he killed his neighbors, James
Carroll, 75, and his wife, Joyce,
74, in November 2003 and fled
to Dallas with their car and
some of their jewelry.
The couple, who had once
paid Acuna to mow their yard,
lived most of their adult lives in
Louisiana, and had returned to
Baytown only two years before
their murders. They lived in a

Ellis said there is a shorter
selling period this year to off-
set the rising costs of diesel
gasoline, which is needed to
help keep the apple-filled
trailer cool at about 37
degrees.
“The apples are costing
about $2 more than last year."
Ellis said. "We did not raise
our prices.”
With six less days of sale
than in the past, club mem-
bers are pressured to sell
$30,000 worth of apples. The
apple sale is the Kiwanis’
only fundraiser of the year.
