TITLE EXAMINATION

How does one know whether

The safest method :s to have
a title examination made—that

a history of a title. Possession
of an abstract no more indicates
ownership of land than posses-
sion of the history of Texas
moans that you own the state.
Some purchasers of land feci
safe because the title is being
examined at the time of pur-
chase by an attorney for the
mortgage lenders. This seems
logical but is a dangerous theory.
Mortgage lenders are sometimes
willing to accept less than good
record title as security. This
is sound business for them be-
cause, among other reasons, the
chances are that the mortgage
will be paid off so that no ex-
pense in perfecting the title
would ever need bo incurred. It
is risk.v business for you when
you are putting your life sav-
ings into the purchase.
These are a few of the reas-
ons why a title examination is
an important safeguard to you.
When it is completed, the at-
torney 'gives you a written
opinion stating his conclusions
as to who owns the land, the
defects in or charges against
such ownership, and the re-
quirements to be met. if any.
to make good record title
Offhand, this may seem a
simple operation. In fact,
not It requires the interpreta-
tion of numerous deeds; mort-
gages. wills, court decrees and
other instruments: the consid-
eration of the order in which
transactions and events affect
mg the title occurred: and the
application of statutes a n d
court decisions to the various
situations disclosed in the ab-
stract.
