MISSOURI INJUNCTION CASE.

hearing was begun In the Federal
district court here In the injunction
suit ot eighteen of the leading rail-
roads of the state to prevent 'tho en-
forcement of the recently enacted laws
reducing freights and passeriger fares
the latter to two cents per mile. Ar-
guments on the plea for the injunction
will consume the day.

Mayor Schmitz charged with extor-
tion appeared In Judge Daniels court
today and his attorneys will ask for a
legal stay of proceedings before any
sentence Is pronounced. The maxi-
mum penalty Is Ave years Imprison-
ment in the state prison. The Mayor's
attorneys will apply for writ to pro-
bate cause. If application is denied
an application will be made to the
district court of appeals for a new
trial.
Tho district attorneys will insist
that Schmitz be confined in tho city
prison.

tive committee of the Association of
Life Insurance Presidents met today
and it was later announced that the
association would make no effort to
test by court proceedings the consti-
tutionality or validity of the new laws
affecting life Insurance companlos In
Texas. Though counsel had been ad
vised that the laws were unconstitu-
tional it would seem to be the unani-
mous opinion ot the committee that
tho laws until repealed represented
the judgment of the people of Texas
and thoy should not be furthor oppos-
ed by tho companies affected.

stantly killed today at his farm five
and a half miles east of Kaufman by
a kick from n mule. He was at work
