Residency of District Attorney
Tim Cole questioned
Motions were filed last week in the
97th District Court to disqualify Dis-
trict Attorney Tim Cole from office.
The motions were filed by Donald
T. Fulton, attorney for a Bowie man
convicted of aggravated sexual as-
sault charges and sentenced to 99
years in prison. Bernard Beavers
was also sentenced to 20 years on
each of two charges of indecency
with a child, all involving a young
girl. The motions claim that Cole
doesn’t meet the in-district residency
requirement set out by the Texas
Constitution.
Cole maintains homes in both St.
Jo, v/here he grew up and where he
is registered to vote, and in
Lewisville, where his wife and chil-
dren reside, and where his children
attend school.
“This is old news,” he stated by
phone Monday. “This has been
known since 1995, and although my
opponent in 1999 brought the issue
up, none of my opponents filed
written challenges because they
knew it wasn’t important.”
He went on to say that he first
bought a home in Lewisville after
finding a teacher there that would
be an asset to the education of his
son, who suffers from autism. In the
last 11 years, he has owned or rented
several homes there.
“But it’s like owning a home in
the mountains; my Lewisville home
is the temporary one.”
Other motions seek to recuse Dis-
trict Judge Roger Towery and a new
trial for Beavers.
“I’m not worried,” stated Cole.
Civil lawsuit comes to conclusion
in Archer County Court
A civil trial, held in front of an
Archer County Grand Jury, closed
last Friday, resulting in a $3 million
judgement awarded to Joyce
Strange of Holliday. She had alleged
the W.L. Lindemann Operating Co.
diverted oil from the Strange Lease
to Lindemann leases, and brought
suit against the company and W.L.
“Rusty” Lindemann. The jury, how-
ever, found no liability against
Lindemann himself, only against the
company.
The jury deliberated for about
four hours, reaching a verdict at
about 6:15 p.m. Friday.
An appeal is expected, and either
side could appeal. Both teams of
lawyers are evaluating the issues at
the present time. Mrs. Strange was
represented by Kirk Crutcher of
Mayfield, Crutcher and Sharpee of
Amarillo, and Lindemann’s attor-
ney was Lonnie Morrison.
Christmas on the Square
plans underway
The Community Activities
Commitee (CAC) will host Christ-
mas on the Square Saturday, De-
cember 3, 2005. This event will in-
clude a parade at 5 p.m., food and
craft booths, singing stage, and tour
of lights. At 7:30 p.m., the final
night of Miracle on 34th Street will
be playing at the Royal Theater.
"With all the natural disasters and
sadness in the news this year, we
just want to get everyone together
in a fun way to lift our spirits," said
Cathy Mueller, event coordinator.
"I would love to bring back the
warm, small town Christmas spirit."
Plans for this event include
everyone's participation. This is a
great opportunity for groups to hold
fund-raisers selling Christmas
crafts, hot chocolate, popcorn balls,
etc. The CAC is setting a small fee
for food or craft booths to cover
expenses of putting this event on.
The windows on the square will be
decorated and all businesses are
asked to really light it up this year.

in the parade or a booth, contact
Cathy Mueller at 574-4886,
